(MI) Attorneys Ask Court to Stop Hearings (Kilpatrick Sues Granholm!)

(WXYZ) Mayor Kwame Kilpatrick's legal team is asking the court to step in and stop removal hearings that are set to take place on September 3rd.

In a complaint filed with the court, the mayor's attorneys argue that Governor Jennifer Granholm has made prior statements indicating that she has prejudged the matter and will be predisposed to remove Kilpatrick from office.

Attached is a Summons, Complaint and Emergency Motion for Temporary Restraining Order and Preliminary Injunction which was filed today.

A hearing before Judge Ziolkowski is scheduled for Friday, August 29th at 10:00 a.m.

The Detroit News says "In the 30-page brief filed by James Thomas, Mayor Kwame Kilpatrick's criminal attorney, they are asking for a court injunction.

They allege they are not receiving "fair and just" treatment as is outlined under the state Constitution.

There was no immediate response from the governor's office.

Attorney Bill Goodman, who is making the case on behalf of City Council for the mayor's ouster, said the filing "is both frivolous and maniacal at the same time."

Actually, I've been following this on the Free Press (barf) website for the last few months, and Granholm has, if anything, been dragging her feet and generally staying quiet on this whole affair.

She's goofing up by acting so slowly (though extreme prudence is required in applying that law she can use, the threshold for ousting King Kwame was passed long ago), but she's actually seemingly playing it smart in keeping her mouth shut.

Why not make frivolous motions. Kilpatrick isn't paying for his lawyers, the city is.

The people elected him and let him continue to rule the city as Marian Barry did in the Disctrict of Columbia!

Steve Wilson is reporting that Kwame knows his days are numbered in office. Once he’s out he wants to lay low for two years and run again for Mayor.

Unbelievable...but I should know better by now.

“Quietly, he had recruited a new squad of local lawyers with connections to the Governor, the Attorney General and the Wayne County prosecutors. Their marching orders? Use those connections to hammer out a deal because, we’re told, Kilpatrick was:

• choking on mounting legal bills;

• facing those new felony assault charges not as murky as lawyers can spin the whole text message scandal;

• the possibility that Christine Beatty would save herself by testifying against him;

• and even if the council couldn’t remove him, removal by the governor was looming large …

And even before Governor Granholm announced her decision to begin hearings next Wednesday and render a quick and binding decision? Kilpatrick concluded she would remove him…and the clock was ticking. All the while, so many others like local preachers who had never before forsaken him were either calling for him to go or just keeping quiet.

One source close to him tells me two weeks ago the mayor came to fully realize his only bargaining chip is an offer to voluntarily leave office. He’s said to have decided if he goes, he can lie low for two years and run again, believing that like former Washington Mayor Marion Barry caught on camera with crack in a hotel room, Kilpatrick can rise to power again, that Detroiters will forgive…or forget.”
