Obama not eligible to be CIC?

What about this? Any truth to it?

Obama is NOT ELIGIBLE to be President. We already know that Obama is not QUALIFIED to be President, we now know that he is not ELIGIBLE to be President under American law. This is a great comment to a post over at Michelle Malkin’s blog:

US Law very clearly stipulates: “…If only one parent was a U.S. Citizen at the time of your birth, that parent must have resided in the United States for at least ten years, at least five of which had to be after the age of 16.” Barack Obama’s father was not a U.S. Citizen and Obama’s mother was only 18 when Obama was born, which means though she had been a U.S. Citizen for 10 years, (or citizen perhaps because ofHawai’i being a territory) the mother fails the test for being so for at least 5 years **prior to** Barack Obama’s birth, but *after* age 16. It doesn’t matter *after* .. In essence, she was not old enough to qualify her son for automatic U.S. Citizenship. At most, there were only 2 years elapsed since his mother turned 16 at the time of Barack Obama’s birth when she was 18 in Hawai’i. His mother would have needed to have been 16+5= 21 years old, at the time of Barack Obama’s birth for him to have been a natural-born citizen. As aformentioned, she was a young college student at the time and was not. Barack Obama was already 3 years old at that time his mother would have needed to have waited to have him as the only U.S. Citizen parent. Obama instead should have been naturalized, but even then, that would still disqualify him from holding the office.

*** Naturalized citizens are ineligible to hold the office of President. *** Though Barack Obama was sent back to Hawaii at age 10, all the other info does not matter because his mother is the one who needed to have been a U.S. Citzen for 10 years prior to his birth on August 4, 1961, with 5 of those years being after age 16. Further, Obama may have had to have remained in the country for some time to protect any citizenship he would have had, rather than living in Indonesia . Now you can see why Obama’s aides stopped his speech about how we technically have more than 50 states, because it would have led to this discovery. This is very clear cut and a blaring violation of U.S. Election law. I think the Gov. Of California would be very interested in knowing this if Obama were elected President without being a natural-born U.S. Citizen, and it would set precedence.. Stay tuned to your TV sets because I suspect some of this information will be leaking through over the next several days…

I think Obama’s campaign is setting up issues like this and the Muslim thing in order to say “see, the GOP is swift boating me, they have no new ideas”.

Then when people FINALLY get to the real issues, his hard left policies that are neo-marxist he will just call it another smear and ignore it.

It is the little boy who cried wolf syndrome and the MSM will go right alone with it.

Wow, really? Well, Ok then.

I have to say I’m astonished, nay gob-smacked, but if that is the case - that Obama really doesn’t have to produce certification due to simple precedent - then it’s not worth worrying about this a moment longer.

But do any of the other elective jobs require you to be native-born? If the President is the only such job, then I think we may justly challenge Obama on it.

If he was born in Hawaii then under the 14th amendment Obama is a natural born citizen, even if his parents were two space aliens from the planet Mongo.

The question is, can Barry prove he was born in Hawaii? He probably can, but so far he hasn’t.

Obama’s mother was born in Kansas...she didn’t have to be naturalized, she was a US citizen by birth. Is there any evidence she was ever in Africa in her life? She met Obama’s father while he was a student in the US.

I have felt all along that this is not about where he was born. IMO it appears dubious that his parents were legally married. If this is the case, the original birth cert would show that he was an illegitimate child. I would imagine the campaign feels this would not play well with some percentage of the population and therefore does not want to release the original birth certificate.

I don’t remember any question of eligibility of a presidentail candidate ever arising before in our history.

Whatever the merits of the discussion about fake birth certificates, I have this question:

Is there any mechanism for checking something like this out? Is the Federal Election Commission empowered to check on the qualifications such as age, citizenship, etc. If not, who is?

I think its something else as well, not whether hes a citizen or not. I find the race description "African" odd, maybe that's the item being messed with. I've read on a number of threads that he's only 6% black or some such nonsense. I know this is out there, but maybe he father was listed as something other than black (Arab maybe) and they are trying to hide that.

He was born in the united states. His mother didn’t have to be married or a citizen.

You are correct.

There three ways to become a US citizen. The first two meet the requirement of being “natural born”.

First is Jus Sanguinus the “law of blood” where by you derive citizenship through your parents as in the case of McCain.

Second is Jus Solis the “law of place” meaning being born in the continental US or territories including Hawaii (at that time), Guam, Porto Rico and I believe the US Virgin Islands. This is how Obama qualifies.

Third is through naturalization.

People need to get off this its making us look stupid. If he was born is Hawaii he is a US citizen through Jus Solis. If he was born overseas only then would the status of his mother come into question.

It’s generally only considered ex post facto for constitutional purposes if the change has a detrimental effect on the person, and then not even in all cases.

Actually, “born in America” pretty much nails it, unless his parents were foreign diplomats posted to the U.S.

It was my understanding she lived in Africa for years no matter where she was born. She came back to HI to have the baby. If she lived overseas for many years and take a husband from there, she can't just come here and have a baby in the US and go back to Africa. There is a time limit to be here fro HER to be naturalized, not BHO. He is a citizen( I don't agree with it, but that's the way it is), but she cannot live in Africa for years and just come here to have here baby. That's the story I'm hearing from the people trying to foil BHO’s plans. I'm not an immigration lawyer.

I think a search here on FR will get the gist of what they are saying. If she had him at 18 in HI and spent many years over in Africa, then what they are saying is she couldn't have satisfied the time requirement.

There were questions raised at the time about Barry Goldwater’s eligibility (he was born in Arizona when it was a territory), and also about George Romney (who was born to U.S. citizens in Mexico). Both questions were answered in favor of eligibility.

Mac was born to natural American parentS on a US military installation.

We don’t really know where Obama was born or by what parents of what actual citizenship under which laws of the times and places. His mother was supposedly an American citizen, but did not meet requirements making her son a natural born citizen. There is also no apparent record of his “father’s” Kenya origin or his marriage to Obama’s mother. It has been reported he had two or three other wives at the time. Spell bigamy. “Leaked” copy of his birth certificate are apparent fakes. Passport and and Social Security documents based on official birth certificate records have not been provided. Hawaiian officials cannot/will not release any records. Obama is not providing any official records to verify/clarify the situation. Even Hillary is staying quiet because it is not in her best interest to rock the boat whhile she is riding it. You can bet her operatives have the info and will use it when the timing is right for her.

Meantime we are still waiting for John Kerry to release his actual military records. Obama is following Kerry’s playbook.

Summary: Macs records are officially documented. Obamas are not.

A point of clarification, I was basically asking - is this claim as spurious as the John Sidney McCain is not a native born citizen claim that was passed around awhile back, or does this "Barak Hussein Obama can't be CIC" claim have real substance?

I did not say that I supported the John Sidney McCain non-CIC claim

Please read post #50. IF Obama was born in Hawaii, then the residence or citizenship status of his mother (or father) is irrelevant. The only exception I know of to this rule is if, at the time of his birth, his parents were foreign diplomats posted to the U.S.

That’s the first time I heard that Obama’s mama lived in Africa. His father was admitted to the US under a program that started near the end of the Eisenhower administration, so they met in the US. If she was born in Kansas, she wouldn’t lose her citizenship by living in another country unless she renounced her citizenship.

I agree with you, I'm just giving the supposed angle the doubters are using. If BHO was born in HI, nuff said.

I'm interested in his birth certificate to see his given name. I was interested to see if he was born with BHO or took it later having been recruited into the Farrakhan "bow tie" squads. Remember, Malcolm X was born with that name. It makes a difference to the fly over country if he is a black nationalist. That's what his church taught after all( for 20 years). If that's true, it would put him in the Marxist revolutionary camp like in Zimbabwe. Do we want to live like they do? Do we want to even live like they do in Detroit?

If he was born BHO, then he can't help what momma named him. If it was a conscious choice, that's a whole nuther kettle of fish.

There can be only 2 reasons to hide his BC. Either he wants to show us to be bumpkins and he produces it in Oct, or he has something to hide. It seems to me we shouldn't have to take the Daily KOS at their word for something this important. Shouldn't someone on the election board have asked to see it? Shouldn't they have a copy? I had to produce mine to work at the phone company and they have a copy even today.
