Florida's Bush gets report on Schiavo

Details of the report will be made public Tuesday morning, after Bush's attorneys read it and edit out any sensitive material, a Bush spokesman said.

The recommendations of the guardian, Dr. Jay Wolfson, are not binding on Bush.

The governor issued an executive order in October ordering Schiavo's feeding tube reinserted, and he was not expected to lift it while her fate is litigated.

Possible ramifications for Terri Schiavo? Not being a convicted killer, isn't she entitled to at least the same protections as a convicted killer: to have her case heard by a jury, not a judge? Due process applies to one and all.

WASHINGTON (CNN) -- The Supreme Court announced Monday it will follow up on its ruling that juries, not judges, must be the ones to impose death sentences on convicted killers, by clarifying whether its decision can be applied retroactively.

They also argue it violates the separation of powers by allowing the executive and legislative branches to overrule a judicial decision.

Let me get this right. It is okay for one branch of (sometimes) unelected appointees to overrule TWO of the branches of government for purely political reasons, but not for the other two to overrule the first to save someone's life?

WASHINGTON (CNN) -- The Supreme Court Monday ruled 7-2 that it is unconstitutional for judges rather than juries to make findings of fact that result in a person being sentenced to death.

Food for thought. I expect this ruling will be referenced in the Schiavo case, as Bush presses for a trial to determine the actual 'facts' of the case. Although Terri was never charged with a crime, "findings of fact that result in a person being sentenced to death" must be judged by a jury, rather than a judge. Was not Terri sentenced to death? Evidence used to end her life must be weighed by a jury. That a judge, a former Zoning Board attorney, could kill her using contested, contradictory hearsay evidence is SICK.

Where do I file for an abatement? LOL
