DC Court Tells Catholic Groups: Submit to HHS Mandate or Pay Massive Fines
NC Register ^ | May 22, 2015 | PETER JESSERER SMITH

WASHINGTON — A majority of judges on the D.C. Circuit Court of Appeals this week rejected a request from the Archdiocese of Washington and Priests for Life to have the full court review their challenge to the Health and Human Services’ contraceptive mandate.

According to the archdiocese and Priests for Life, the mandate as it currently applies forces them to be complicit in the provision of contraceptive services, including abortifacient drugs that seriously violate their Catholic beliefs.

“We concluded that the regulation challenged in this case does not, as a matter of law or fact, give plaintiffs’ conduct the contraception-facilitating effect of which they complain,” stated the majority ruling, written by Judge Nina Pillard, in denying relief from the mandate under the Religious Freedom Restoration Act (RFRA).

The 6-3 ruling was followed by two strenuous dissents, one from Judge Janice Rodgers Brown, joined by Judge Karen Henderson, and one form Judge Brett Kavanaugh, which agreed with the plaintiffs’ contention that the federal government’s “accommodation” still violates the religious liberty of the Catholic organizations.

“Make no mistake: The harm plaintiffs complain of — and the harm this court therefore is called to assess — is from their inability to conform their own actions and inactions to their religious beliefs without facing massive penalties from the government,” Brown’s dissent read.

In a May 21 statement, the Archdiocese of Washington stated that it was “disappointed” the appeals court denied the petition for a full review of the case. The archdiocese and Priests for Life filed the petition with the court after a three-judge panel ruled the HHS mandate did not violate the rights of religious objectors.

The archdiocese added that it would very likely be appealing the “erroneous” decision to the U.S. Supreme Court.

Blomberg said these rulings are not good for religious liberty. “It’s not good for religious liberty because the federal government is interpreting their religious beliefs for them and telling them when their religious beliefs can be protected and when they can’t.”

Catholic ping!

How many times has the court been forced to overrule on the SAME mandate? 5? 6?

Gee, where is the separation of church and state the progs are so proud of?

At least in Iran, religious mullahs make religious decisions.

Here, several blackrobe lawyers make religious decisions with the force of secular law.

This is tyranny, and tyranny isn't government.

Bush should be charged with treason for not putting Janice Rodgers Brown on the Supreme Court.

One of the reasons this country was founded was RELIGIOUS FREEDOM. The SCOTUS had better uphold the Constitution or the people will give up, roll over and die. Why bother if the heads of the Judiciary can’t be bothered to follow the Law? The (in)Justice Dept doesn’t bother to follow the Law and that has been completely demoralizing to the electorate. Where can we turn if those we have elected and those who have been appointed to serve US, can’t be bothered to follow the LAW??

IIRC, he brought her name up for consideration and the Dems blocked her. IIRC, not one of them was accused of racism for their actions.

Remember, to the leftists and the president, the ‘right to worship’ means you are free to do it as long as you do it in a cave far from anyone else. Oh, that isn’t in the constitution, don’t worry, he’ll put it in there.

These leftists are adamant about abortion over almost anything else. You would think that these leftists are really just committed Satanists that need the abortion of innocents as a blood sacrifice to their god Lucifer.
We seem to be transforming into some sort of sick occultist theocracy.

Everything that the devil wants, the federal government wants: abortion, destruction of traditional marriage, the Bible classified as hate speech, alienation of Israel, the total centralized surveillance state, elimination of cash replaced by government digital bank accounts (leading to the mark), forced medical treatment via vaccines, federal government control of schools, health care, churches, police.

And American Muslims are exempt from Obamacare. But Christians are being persecuted with Obamacare. Who is going to fix this?

How can Christians continue to support a government that has shown such utter HATRED of Christ and His church? I’m not even Catholic, and this makes me mad.

That is a shockingly evil and unconstitutional ruling. The court’s directive violates the First Amendment’s guarantee of freedom of religion, the Eighth Amendment’s prohibition against excessive fines, and God’s creation of people with fundamental human rights. This ruling has no legitimacy, since government’s just powers derive from the consent of the governed, and it should be appealed, resisted, and disobeyed. To follow an illegal and unlawful order of this nature would be a crime against God.

Hey judge!

We’re going to appeal your idiotic ruling and then sue the plaintiff for costs and damages.

I see CWII on the horizon.

In another 20 years:

Prayers for all churches, etc.

Christian morals do count. Keep trying to buck this stupid rule in Obamacare.
