SAN DIEGO -- A full panel of federal judges has declined to rehear the case of a war memorial cross in a public park in San Diego that has been deemed unconstitutional by the court.

A group fighting to preserve the monument announced Monday that the 11-judge panel of the 9th U.S. Circuit Court of Appeals denied its request. Five of the judges dissented, stating the cross should stay.

A three-judge panel in January ruled that the cross conveys a message of religion and is unconstitutional.

Kelly Shackelford says her organization will appeal to the Supreme Court. Shackelford is an attorney for the Mount Soledad Memorial Association, which oversees the monument.

How can the 9th Circus Court be considered Constitutionional—or even reasonable. They will not rehear the case—Even the Presidents stooge in the Black Panther Just US Selling Guns and Grenades to the Mexican Drug Cartels and Violent Gangs Dept.wanted the case reheard. Thank God in Heaven I was able to see the Memorial when I was on orders for Vietnam-Not even the 9th can take away memories. Funny but it took a bloody Civil War to correct an error by the supreme Court when it was Taneys Court May take a war to correct the 9th Circuit Court of Schameels. There is NO JUSTICE from these BOZO’s

Sadly, I doubt SCOTUS takes this one.

I believe in Arlington, they have the appropriate religious symbol of the deceased.

What's so weird is that at one time FDR (liberal icon)pushed a button on his desk symbolically lighting up a cross on "public land". Nobody in 1943 thought it was anything to get bunched up about. Now we have a lunatic fringe that would spend millions of dollars to prevent such an event from ever happening.

I've always wondered just why a person would spend their entire LIVES trying to oppose things they don't even believe in. I don't believe in the Easter Bunny, but if "he" appeared at a public park, I couldn't care less.

Hm, I think Kelly Shackleford is actually a man, not a woman.

The former House Speaker said that after the inaugural address, there’s a break before the traditional lunch — an opportunity for a newly-elected president to get right to work.

“Walk into a room, have all the documents already prepared, already on the Internet, already reviewed by the American people, already written by people who were in the Bush and Reagan White Houses, so they’re all technically correct,” he told the audience. “And just sign as fast as you can.”

Gingrich called for abolishing the Ninth Circuit Court, which he sees as part of an activist judiciary, abolishing all “czars” created by the Obama administration and ensuring no American money pays for abortion (the Constitution specifically gives Congress the power to “ordain and establish” lower courts).

So do chapels on military posts, so do crosses in national cemetaries

I guess they are next.

So, would you agree or disagree with this, cardhu? a Mormon wouldn’t like the symbol of the Cross, neither would any other non-Christian.
