The 9th Circuit is the most liberal and maverick federal appeals court in the country.
legal experts have taken note that the ACLU drew what one law professor called a ``dream panel'' -- Judges Richard Paez and Sydney Thomas, appointees of President Clinton who are widely regarded as liberal to moderate, and Pregerson, a Carter appointee and liberal firebrand who has openly questioned the death penalty and California's ``three strikes'' law.

DAVIS WINS!!!!!!!!!!!!!!!!!!

Greek for "judge" is "krites". I think that makes us a critocracy.

Certiorari does NOT have to be granted. Judge Napolitano, who's usually very good on these matters, is wrong this time. My first win in the Supreme Court was Emergency Relief granted by a single Justice. The whole Court NEVER did accept and hear that whole case on the merits. (McCarthy v. Briscoe, September, 1976.)

Gray-out's going to get some full-time help. John Kerry's comm director, Chris Lehane, has resigned. Lehane was helping the anti-recall forces on the side apparently.

Again, what about the absentee ballots already sent out? And the military ballots? People have already voted. What happens to those?

you wil never get a 9-0, the SCOTUS liberals know exactly how they are supposed to vote. they would force a 5-4, and the Dems would have it as a campaign issue.

Draft the gangs if they enjoy killing and sent to Iraq.

WHew, I'll say the odds are high. The 9th Circus verily reeks of Clinton-appointed liberals.

AND>>>

What if the Republican absentee votes, already sent, are split, and a Republican drops out before the new election date? Do they get thrown out? Will half the military votes be lost?

This is darn near reaching watermelon and grain alcohol territory...

I'm ready to break out my toga, but by the time this gets resolved, it may be a bit too nippy to wear a toga in Wisconsin, indoors or outdoors.

Too weird, just too darn weird.

I just knew that crazy zany 9th circuit would get into the act.

I'm sure their reasoning is 100% free of reason.

Thank you. I'm not admitted to the Ninth Circuit, and was relying on reports on Fox News that obviously counted all of the judges, without regard to whether or how they could participate in this.

One more example of why to trust Freepers over reporters.

You're right that the stay (probably by O'Connor, although additional Justices could sign on if she chooses to refer an emerg. stay request to the full Court) need not await a grant of cert (although presumably some rudimentary PETITION for cert probably would have to be on file). Really such a stay, as I understand it, is intended to preserve the status quo (or status quo ante) while the Court can consider a cert petition.

So technically, O'Connor could stay ... then the Court could just take its time evaluating the cert petition. If it waits through October 7, it may deny it as moot.

But I'd like to see something issued on the merits, something indicating You (Ninth Circus) Once Again Have Gone Too Far.
