Thanks, sir. I always enjoy your analyses of these issues. I don't practice constitutional law, but was very interested in it in law school (UCLA '81) and did a couple of seminars in the field. I was always troubled by the federalism implications of the one-man, one-vote cases and, absent the sort of de jure discrimination that traditionally triggered equal protection intervention , thought the were wrongly decided. The impact of those decisions on California were incalcuable, essentially giving almost complete control to the populous South and resulting in the massive water and energy transfers of the '60s and '70s.

SCOTUS should just issue an emergency stay of the 9th's ruling until October 9 and then just dismiss the appeal as moot, the election having come and gone....
