I don't see this as a winning strategy for the RATS... it is more like a Hail Mary pass in the hope that the USSC won't reverse... if the USSC does indeed reverse, it still hurts Davis and Bustamante for getting people fired up.

As an aside, will this take any steam out of the Democrats' national campaign charge that Republicans are trying to steal elections or will this embolden them to say that they are preserving democracy by stopping the recall?

The key point here is that if you apply the thinking of the 9th Circuit to its full and logical conclusion, there will always be differences in voting methods - they will never be exactly the same. Therefore, we should just forget this voting idea and just let the judges rule the land.

No recall, but here is the procedure for complaining:

Section 351 of Title 28 of the United States Code provides a way for any person to complain about a federal judge who the person believes "as engaged in conduct prejudicial to the effective and expeditious administration of the business of the courts[.]" 28 U.S.C. § 351(a) (formerly codified at 28 U.S.C. § 372(c)). The Ninth Circuit local rules provide a mirror mechanism by which an individual can file a complaint about a federal judge. See 9th Cir. R.. Jud. Miscon. 1.

Hi, Chris,

The Supreme Court CAN decline to hear any case (and does so about 99.5% of the time) that is not in their "original jurisdiction" as set out in the Constitution. However, the Court CANNOT and DOES NOT refuse to act on any request for Emergency Relief. ALL such requests are acted on, one way or another.

I know. I've made several such requests to that Court. Usually they are denied, with the appropriate Justice signing his/her initials, the date, and writing "Denied." on the pleadings. When the Court GRANTS such relief, it issues a one-Justice opinion, usually reciting that "four [or more] pf my colleagues agrees with this conclusion."

The prevention of the people's will by judicial fiat; and keeping a highly unpopular, weak and ineffectual Democrat in power.

Hardly stuff of which to be proud, and utterly representative of the pathetic state in which the Dems find themsleves.

In the end, the 'politics' of the Supreme Court will play just as much role as the particulars of the case law. Don't be surprised in the slightest if the SCOTUS issues a summary affirmation and skips this issue altogether. This Supreme Court has never evidenced the slightest hesitation to influence the political process, whether by action or by inaction as the case may be...

Actually, I would be surprised if they actively affirm this. They will either decline to take this case (which would serve the same purpose without taking on any of the political heat) or decide to damn the torpedoes and strike down the 9th for way overstepping their bounds.



Over on FoxNews, the chairman of the Kalifornica DemonRAT Party is trying to claim that it's only now that the punch-card machines that his party's been stealing elections with for decades, are a bad thing. Huzzah to Jon Scott for filleting him on the air.
