The Legal Beagles are going to start a hot CWII.
That didn’t take long ,LOL
I thought the SCOTUS decision was only temporary, until the case was heard and decided by the Appeals Court. So it not an over ruling as I see it, but I’m not a lawyer so I could be wrong.
How does a lower court overrule the SC
Dear Gov. Abbott;
Just Do It!
Sincerely,
North Mountain
Contrary to the poorly written story, the Supreme Ct. has not made any ruling on the case. No court has thumbed it’s nose at the Supreme Ct.
The Supreme Ct. first refused to issue an emergency stay of a lower court order that struck down the Texas law.
The Supreme Ct. next refused to issue an emergency stay of a temporary appeals court ruling in favor of the Texas law (this stay sought by the Biden Administration).
Stupid headlines portrayed the refusal of emergency stays as the Supreme Ct. first striking down the Texas law, then upholding the Texas law.
The Supreme Ct. has just refused to get involved because the appeals process has not played out.
Many times I’ve heard that the Supreme Court of the United States is the highest court in the land. Then how come a lower court can over rule them without additional evidence?

All those fresh illegals should be deposited INSIDE the gated communities of the Communist and Nazi Democrat judges.
“daring to tread on what they perceive as exclusive federal ground.”
That is not what this is. That is the excuse. The rats willfully refuse to enforce federal law and will stop any state from enforcing it on their own.
This is getting ridiculous. How can a lower court block a SC ruling?
I don’t understand how a lower court can take precedence over the highest court in the land - SCOTUS????
How does a lower court overrule the SC

It was a temporary order pending Appeals Court ruling, as I understand it. Everyone assumed it was final and hyped it that way, but it was not final.
But lower courts often overrule SCOTUS when the plaintiff takes the case to another court and the defendant does not have the money to pursue. So the plaintiff wins, even though SCOTUS ruled against them.
I can cite at least one case where that happened. Its really in the weeds, but it does happen. There is never any publicity about it because the media has moved on.
Do it anyway.

“John Roberts said there are no Trump judges or Obama judges. Clarence Thomas didn’t get the memo.”
My go-to clown, traitor comment.
