Trump documents case: a judge wonders why he was the only President who has been charged over his handling of classified material?

“Novel legal theory,” a term applied in whole or part to every case, criminal and civil, lodged against Donald Trump. That term is best understood as using the law in ways it was never intended to be used, and/or never has been used, most specifically for political purposes. A "novel legal theory" might consist of applying a vicious dog ordinance to someone who owned only a parrot that could bark like a dog.

During my police career, professional officers were careful never to use the law in that way. If there was a law on the books that had never been applied to anyone, they wouldn’t use it either. If there was the slightest hint of political bias in an arrest or prosecution, police supervisors, or failing that, prosecutors, would dump the case. They would do the same for even the appearance of selective prosecution. But that was before Donald Trump and the fierce necessity of saving “our democracy,” a tyranny of the majority. Now it seems at least one judge might be returning to the ethics of those thrilling days of yesteryear.

The judge overseeing former President Donald Trump’s Florida case questioned during a Thursday hearing why he was the only president who has been charged over his handling of classified material, according to multiple reports.

During a hearing to consider various motions Trump filed to dismiss the case, Judge Aileen Cannon noted no former president had similarly faced criminal charges over the handling of classified material, according to NBC News. Trump’s attorneys brought up special counsel Robert Hur’s report finding evidence President Joe Biden willfully kept classified documents, but declining to charge him, according to CNN.

Bratt is not conceding the issue, but arguing that unlike every former president who kept classified materials, Trump did far, far worse. He obstructed justice and…other stuff.

How did he obstruct justice? The Presidential Records Act, adopted in 1978, allows presidents to declassify and keep anything they chose.

It defines no formal process for declassification. Only presidents have this authority, and any arguments under the Act are a civil, not a criminal, matter.

Trump’s lawyers were continuously negotiating with the National Archives, and the materials were under constant Secret Service protection in a single place, unlike Joe Biden, who never had authority to have such materials and kept them for 40 years(?!) in as many as seven, unsecured places to which innumerable, unknowable people had access.

Trump even gave the FBI full access, personally told them to let him know if they needed anything else, and added an additional lock when they later asked for one. The DOJ also has a policy never to prosecute a political candidate during an election, but this case is different because Trump.

It’s rather hard for the rational person to see how that constitutes obstruction of justice, but Trump Derangement Syndrome sufferers see things differently than the sane.

IMHO I suspect that every president alive has classified documents in his library. All should be investigated if one is investigated...

If they get Trump on this, they will have to make Biden fall as well. Because there can’t be a double standard justice system in America.

But maybe that is their secret wish/plan?
Because the Democrats secretly don’t want Biden at all...

Thus, they would get a win-win if the plan goes through...

I am at the point that if justice can’t be equal and blind for everyone then nobody should have it. Blow up the system completely. It is worthless like it is now. Worse than that, it is dangerous this has already been seen.

Well trust me, they will never be able to make Trump fall on those documents he kept (like all presidents before him). Biden did 5 times worse with documents he kept from the days he wasn’t even president... Thats why they can’t make Trump fall on this issue, because it would de facto make a spectacular double standard making it impossible for Biden not to fall.

They can ATTEMPT to make Trump fall for this, but it won’t go very far.
But IF they succeed, then Biden has to fall as well. Otherwise there will be a revolution in America fueled by a sentiment of unhinged frustration.

There is a limit how far double standards can go.

THEY ** ALREADY ** gave Biden his pass on his document retention.

Done! Signed, sealed and delivered. NO ONE will **EVER** go back and undo the decision of the Special Counsel.

Meanwhile, the Trump persecutions all drag on. The Georgia case continues, even after the D.A. has been exposed as a corrupt and nasty slut, paying off her booty call with Georgia taxpayer money.

Did you notice that? It happened last week. Now she gets to continue the prosecution of Trump. With an all black Democrat jury in Atlanta.

Trump is not charged with keeping classified information. That's widespread misreporting of the case. I read the entire indictment when it first came out.

He is charged with violation of the much older Espionage Act. The Espionage act (origin in WW1) predates the modern classificaion scheme (origin WW2) and the laws that enforce it.

BECAUSE: Everything you say (and others have said) is TRUE: Trump did have the right to declassify thing, as he saw fit, without a requirement to follow any particular process, the STATE is not claiming he broke any "Classified Documents" law.

They are claiming he broke the Espionage Act by providing (or not protecting) material potentially beneficial to an enemy.

You can read the indictment yourself to verify this. Most people (including apparently most MSM reporters) don't bother to do that. (Lazy jerks).

Thanks for that clarification. The selectivity of prosecution is as strong with the use of the Espionage Act as it would have been, had the indictment been about keeping classified documents. After all, lest we forget, Biden kept sensitive defense related documents in his freaking garage and at various other non-secure locations around town.

There certainly shouldn’t be, but, in fact, there is.

Consider, President Trump has been found guilty of fraud for borrowing money that he repaid to everyone’s satisfaction.

He’s been found guilty of sexual assault on a woman who cannot even recall the year the alleged attack took place. In addition he’s been found liable for denying the assault has occurred.

He’s been charged with a felonies for making a phone call to Fulton County, Georgia

Gay sex videoed in a Senate hearing room? No problem. People walking between the velvet ropes on January 6; years of incarceration.

You're absolutely right. 10-1 Bill Clinton took plenty of classified documents with him when he left the White House, and then there's Hillary who sent classified documents through her personal email account. She also advised State Dept. aides who claimed they were having problems sending documents with classified headings, to strip the headings off, and send them that way, even on an unsecured network. Then of course, there was her sending classified documents to her maid at her Washington residence, so she could copy and collate them for her.

That’s not obstruction. The obstruction charge comes from Trump directing his aides to move the documents.

I am of the opinion that the records act and the other law(s) applied by DOJ against Trump do not and were never meant to apply to a president or former president. I don’t exactly remember how I reached that conclusion but I doubt I am the only person who believes it.
