Bolton: Colorado Disqualification Decision ‘Incoherent,’ SCOTUS ‘Will Reverse’

Former National Security Adviser John Bolton said Tuesday on CNN’s “The Source” that the Colorado Supreme Court decision disqualifying former President Donald Trump from the state’s 2024 ballot was “incoherent,” and he predicted it will be overturned.

Partial transcript as follows:

KAITLAN COLLINS: Ambassador Bolton, when you look at this, this measure that was put in place to to keep former confederates from returning to power, I mean, what do you make of it being used here?

BOLTON: I think it’s completely misplaced. I think this this Colorado Supreme Court decision is badly wrong for multiple reasons. Number one, the 14th Amendment provides that Congress can pass legislation to carry its provisions into effect, which Congress has done on many aspects. It has not put anything with respect to Section Three on the books since just after the Civil War.

Bolton is still correct on many foreign policy issues. Wrong headed on many also but is tough and has convictions, though we may not agree. I’m sorry he and Presudent Trump didn’t better see eye to eye on many things. The bad blood after was just silly and over the top. Bolton is also a peace through strength guy, sorely lacking with Obama 3 (Biden) today.

Bolton was wrong in saying the CO SC ruling was “incoherent”. I read that as Bolton saying that Trump shouldn’t be on the ballot, but the CO SC didn’t state correctly why. Bolton believes the uniparty should be more coherent in limiting our options or elected officials.

And when SCOTUS reverses the lower court ruling I’m sure the libs in CO will go out of their way to undermine the reversal in any way they can.

You’re probably right. I read it as a blatant political move by rabid leftists to keep Trump out of the Presidency, period.

Innocent until proven guilty means nothing to them? Okay, Job Biden is being investigated in the House and is now up for an official Impeachment Inquiry. I say that should disqualify him for running for President again.

Those four leftists need to get the same kind of protest and kickback SCOTUS Roe v Wade reversal justices got, frankly.

Section 5 of the 14th:

“The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.”

No mention of judicial jurisdiction.

Simple reason: State supreme courts do not have standing to rule on eligibility in federal office elections.

I would hope the Supreme Court would be so distressed by the ruling that they paint the Colorado Supreme Court as incompetent, and suggest that any litigant dissatisfied with a ruling there can automatically appeal that to the USSC, and they will automatically review it.

yes, we see that Democrats are all about “democracy”, and free and fair elections, as long as you aren’t allowed to vote for a Republican such as Trump.

How is this fundamentally different from elections in communist countries, in which communists are the only candidates on the ballot?

And, for good or bad, the clause doesn’t apply to the President in any case.

Trump was acquitted of insurrection but it seems everyone has forgotten!?

Trump had a trial (incitement of insurrection) which commenced on February 9, 2021, and concluded on February 13, 2021, with his acquittal. It aired on C-SPAN.

So a lower court is able to ignore the acquittal?

The SC is not the slam dunk we think it is. The Constitution does not lay out primary rules. That said, Trump has not been convicted of anything. So they had no legal foundation to exclude him. I think Trump wins but it could be closer than we expect
