California Attorney Files Lawsuit to Bar Donald Trump from 2024 Ballot

An attorney in Venice, California, filed a federal lawsuit on Saturday to bar former President Donald Trump from California’s 2024 presidential primary election, arguing that he is disqualified due to his alleged role in the January 6, 2021, Capitol riot, according to a report.

The lawsuit argues that the Fourteenth Amendment states that no one can hold office who has previously taken an oath of office to support the Constitution and then “engaged in insurrection or rebellion” or gave aid to those who did, according to a Los Angeles Times report.

The attorney, Stephen Yagman, filed the lawsuit on behalf of a California voter identified as “A.W. Clark.”

Yagman was convicted of one count of tax evasion, one count of bankruptcy fraud, and 17 counts of money laundering on August 23, 2007. Continues the tradition of Zinoviev and Kamenev.

Yagman? Iirc he was a vexatious litigant some years ago against somebody. He is a crank. I just don’t remember the specifics.

No standing. Saw a lawyer on Steve Bannon. The 14th amendment does not mention the president or the vice president. It states ELECTORS for the president or vice president.

Chief Justice Roberts has already said it does not apply to a president. He said the president is not an officer of the government. He is an elected official.

All this effort is merely deep state tactics to further try to smear Trump. It has no chance; the Senate already cleared Trump of insurrection charges in a impeachment court presided over by Chief Justice Roberts.

I don’t know that the lawyer is a Republican or that the person or organization he is working for is a Republican person/organization. Theerfore, why should we blame “Republicans” for this?

Let’s suppose for a moment that all of these 14th Amendment lawsuits are being coordinated.

If so, then that’s a tell. The tell being that they know all these cases are dogs and the chances of them winning any of them dwindle by the day.

More attempted insurance.

There is a recent Supreme Court opinion discussing the scope of the Constitution’s “Officers of the United States”-language. In Free Enter. Fund v. Pub. Co. Accounting Oversight Bd. (2010), Chief Justice Roberts observed that “[t]he people do not vote for the ‘Officers of the United States.’” Rather, “officers of the United States” are appointed exclusively pursuant to Article II, Section 2 procedures. It follows that the President, who is an elected official, is not an “officer of the United States.”

Having only a Democrat on the ballot for president might just shock those who don’t pay attention out of their slumber, and leave no question that the Democrats will do anything to steal the election.
