Senate Democrats announce vote to advance Supreme Court ethics bill

Top Senate Democrats announced Monday that a key committee will vote on legislation to set up a code of conduct for the Supreme Court, tighten financial disclosure rules and beef up recusal requirements for justices.

The Supreme Court Ethics, Recusal, and Transparency Act, led by Sen. Sheldon Whitehouse, D-R.I., and Senate Judiciary Committee Chairman Dick Durbin, D-Ill., will get a vote in the committee on July 20, they announced in a joint statement.

“Whether you agree or disagree with the most recent historic decisions by the Supreme Court, we hope we can all agree on one thing — these nine justices have extraordinary powers under our Constitution,” Whitehouse and Durbin said. “The belief that they should not be held accountable or even disclose lavish gifts from wealthy benefactors is an affront to the nation they were chosen to serve. To hold these nine Justices to the same standard as every other federal judge is not a radical or partisan notion.”

"Since the Court won’t act, Congress will," they said.

Doesn’t this meddling violate the core principle of “the separation of powers?”

Hypocrites, all of them. Congress exempted itself from insider trading laws. Spouses and relatives of Senators and Congressmen routinely are employed in jobs that only exist as payoffs. Members of Congress frequently go on government or corporate paid junkets around the world that are nothing more than thinly disguised vacations. Retired Senators take lucrative jobs with think tanks, corporations, law firms, lobbying firms, and academic institutions that are nothing more than layoffs for services performed. Congressmen and Senators often vacation with wealthy friends and donors. Millions of dollars in campaign funds ultimately make their way into the pockets of politicians or the pockets of family members. What about the lucrative book deals and speaking fees?

Look no farther than former U.S. Senator Joseph Biden from Delaware. He became a multimillionaire during more than thirty years in the US Senate and it didn’t come from saving his Senate salary.

The Senate is a club where members don’t call each other out for their own sins. The “ethics” committee is a sham.

How many of the Dem Senators, wanting more disclosure from the Supreme Court, are today abiding by the rules they wish to impose on the members of the court?

But it is.

Article III of the Constitution creates the Supreme Court. The inferior courts are a creation of Congress. Separation of powers means that Congress cannot impose requirements or regulations on the Supreme Court, but they can regulate the inferior courts that they create.

That said, Article III Section 1 does state that "The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior..." The Constitution does not define "good Behavior," nor does it say who can determine what "good Behavior" is. A reasonable assumption is that the Chief Justice determines "good Behavior" for the Supreme Court, and both the Chief Justice and Congress can determine "good Behavior" for the inferior courts.

The Constitution also does not describe a penalty for violating "good Behavior," other than the suggestion of losing their "Office" for violating it. Whether this is via the impeachment process or pressure from the Chief Justice or from public opinion is not clear.

Only one Supreme Court Justice was impeached by the House of Representatives, but the Senate acquitted him.

The bill would give the court 180 days to adopt and publish a code of conduct, allowing the public to submit ethics complaints that a randomly selected panel of lower court judges would review.

This is clearly unconstitutional. The Supremacy clause says that the Supreme Court is Supreme law of the land. Lower court judges cannot be given any power or authority over the behavior of Supreme Court Justices. It is supposed to be the other way around.

Can one imagine the chaos that would ensue if the Supreme Court overturned a lower court ruling, and then activists file a phony ethics charge against a Justice and a judge from the overturned court sits on the ethics panel "reviewing" the complaint against the Justice?

There is current US Code law regarding recusal of Federal Justices and Judges (28 U.S. Code § 455 - Disqualification of justice, judge, or magistrate judge which states:

(a)Any justice, judge, or magistrate judge of the United States shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned.

(b)He shall also disqualify himself in the following circumstances...

However, it seems to me that the parts of the law regarding Justices of the Supreme Court are unenforceable due to separation of powers, short of impeachment.

This is just Democrat chest-thumping because they can't do anything to sway the conservative-leaning Supreme Court, short of trying to manufacture an open seat for Biden to fill.

This is nothing new. The left for many years controlled the courts and had no problem getting assistance from them. But time, and republican choices, have made the courts more conservative and the left can’t depend upon their decisions to continue their reign of control. So they are doing the next best thing...they are limiting the courts the same way they controlled society...by legislation. The only difference is they are not using the courts to back it because that outlet is no longer available. The courts won’t judge to put themselves on a leash. But brainwashing of the citizens will work until it hits them hard enough. Pain brings out decisions of change.
