After a full media cycle of apoplexy and pearl-clutching, which included Andrew Weissmann appearing on MSNBC to declare “It’s the end of Trump,” CBS is now reporting there is no Defense Department memo about attacking Iran – the foundation of the media claims surrounding the leaked audio tapes from Special Counsel Jack Smith.
Worse still, and exactly as CTH previously outlined, despite the claims by CNN about how this audio would be used as the “central element” by the prosecution of Trump, the audio and mysterious memo are not part of the Special Counsel case.

There never was an Iran memo document. President Trump was discussing newspaper reports, “newspapers” and stacks of “papers”, as he originally told Brett Baier. Duh.
Reminder, in an interview with Fox News’ Bret Baier on June 19, Trump said that at the meeting with the book’s publisher, he was not referring to the document itself, but newspaper articles:
“There was no document… That was a massive amount of papers and everything else talking about Iran and other things. And it may have been held up or may not, but that was not a document. I didn’t have a document per se. There was nothing to declassify. These were newspaper stories, magazine stories and articles.”

Smith is desperate. He knew the document Trump was lying about didn’t exist. If it had, he never would have leaked the audio to CNN. It would have blown his case.

DeSantis guy here. No hand winging from me, I don’t jump on any enemedia reporting about either candidate. I have other reasons why I favor DeSantis over Trump, leave the conservative bashing to the media. It doesn’t belong at FR. I can’t speak for others that use left wing sources to bash Trump, but it won’t be me.
I like them both. I think DeSantis is a great governor, ya kidding Id leave this crap state of CA tomorrow and move to Florida tomorrow if I could. Hate the infighting, wish Trump and DeSantis could let bygones be bygones and come together

That being said, I will admit to tweeking central_va. Other Trump guys and gals here have reasoned arguments that are very persuasive for Trump, but central is just too goofy to resist, kinda low hanging fruit.

I believe the indictment prominently features Trump’s statement about this “document”. That was done to embarrass Trump but is a major boomerang.
Heard this on CBS radio news report tonight. They are so sneaky, their blurb sounded like they were accusing Trump of having this document, but then a quick comment that it is NOT part of the case against Trump.
From what I heard of the recording, Trump was making fun of Hillary Clinton’s mishandling of classified documents. Didn’t sound like what was actually in his hand was anything important. The others in the room were laughing

Apologize for what? Anyone who bothered to read the indictment knew Trump was not charged with anything related to the tape. I’ve been saying this for weeks here on FR. The tape and the transcript are there to lay a foundation for the other charges - by playing Trump’s own words that to most people would sound like Trump was sharing a document that was classified, it establishes in the minds of the jurors that Trump was reckless with national security information. They will likely argue that it shows Trump knew he had classified information and was sharing it with unauthorized people. And because he is not charged with having that particular document, they don’t have to prove that beyond a reasonable doubt. It will be up to the jury to decide if the tape supports their claim and how much weight to give it when considering the actual charges against him.
