After the Supreme Court ruled that states lack standing to sue President Joe Biden’s administration for not enforcing federal immigration law, Department of Homeland Security (DHS) Secretary Alejandro Mayorkas says he will reinstate the agency’s so-called “sanctuary country” orders that shield most of the nation’s illegal aliens from arrest and deportation.
“We applaud the Supreme Court’s ruling,” Mayorkas said

On Friday, the Supreme Court ruled in an 8-1 decision that “a citizen lacks standing to contest the policies of the prosecuting authority when he himself is neither prosecuted nor threatened with prosecution” and thus states lacked standing to sue over the orders.
Texas and Louisiana first filed suit against the Biden administration in April 2021 after DHS started imposing the orders that require Immigration and Customs Enforcement (ICE) agents to only prioritize arrests and deportations of illegal aliens who have been recently convicted of aggravated felonies, terrorists, or known gang members.
Following the Supreme Court’s ruling, Mayorkas said he will reinstate the orders to begin ensuring that most of the nation’s 11 to 22 million illegal aliens are not eligible for deportation.

So the outcome of the Supreme Court implies the USA has no borders and only illegals have standing.
So Texas needs to start enforcing the immigration laws on their terms and force the fedgovs hand, then they have “standing”.
Not only that; this decision violates the Guarantee Clause of Article IV Section 4 of the Constitution.
Is Justice Thomas senile now? I expect the Trump trio of cowards to sell out the country.

Citizens and states are two very different things, so whatever the reason for this ruling might be — that can’t be it.

The head of a federal “law enforcement” agency is supporting the non-enforcement of basic (constitutional federal responsibilities) laws.
Why we fund these federal agencies that are really just political instruments is beyond me.
BTW, during the federal lockdown, mask up and social distancing garbage, when 75% of federal agencies stayed home in some cases for more than 6 months, how did that impact you? Can you say your world came crashing down because some federal government bloated agency was operating on only 25% staffing?

So let me just say: I disagree with this ruling. I’m a supporter of an immigration moratorium for legal & illegal immigration. It’s my most definitive issue. End immigration!!! That being said, the posts regarding this opinion are over the top. The court isn’t saying that average citizens or states don’t have standing to fight illegal immigration or immigration policy. The states in question were asking the court to step in & prevent algal guidance by Biden & Mayorkas about who should be priority deportations. The court said the states don’t have standing to ask the Supreme Court to overrule a legal guidance by a federal agency overseeing a policy- which couldn’t be pointed to in case law. This wasn’t even a ruling on the constitutionality of the legal guidance itself & the court reject stepping in and changing a policy. I absolutely think at this point, however, we have an obvious extraconstitutional attempt by political elites to disregard immigration law & the court should call it out for what it is- a top down gaming of the system by well funded & well connected interests padding their bank accounts 🤔
It was rarely ever used but a lot of Obama BC suits were dropped because of standing. It has certainly been abused if its actually Constitutional.

Legally, SCOTUS was right on this: Immigration and the enforcement of its laws are federal matters, not state matters (though the mishandling by the feds can affect the states). It’s a narrow ruling.
I also understand Alito’s dissent, but his argument was not persuasive. The problem with Alito’s position is that the federal government has the duty to protect against an invasion, but that is understood to be an ARMED invasion of the country. A !@#$-load of unarmed foreigners storming across our borders seeking free stuff is not an invasion that the Constitution would recognize.
