Google’s failure to preserve employee messages in Epic antitrust case merits sanctions, judge says

Google “adopted a ‘don’t ask, don’t tell’ policy for keeping messages, at the expense of its preservation duties,” a federal judge said.

The court ordered Google to pay attorney fees involved in the dispute but is still deciding remedies.

Just as with Billary, those communications are somewhere. IF they want to cooperate, and, yes, tell the truth, they could produce, ‘find’ them. They know that for most democRATS there are no rules, regulations or laws that apply to them.

With no conscience or soul, all that matters is power and $$$.

The proper remedy for spoliation is to strike the offending party’s pleadings, and give judgment to the opposing party.

The judge, James Donato, made clear the case “will not be decided on the basis of lost Chat communications,” but said deciding on the proper non-monetary sanction requires more proceedings.

The Obama stooge is stooging out for Goolag.

You can bet money that if the chat messages had been favorable to Goolag, they would have "appeared" in a New York minute.

Just goes to show...if you have something to hide that’s serious, you’re better off deleting it despite preservation orders.

Hillary proved it with the bleach bit bullshit.

There’s a quite simple way to make sure records are retained. The fines go directly to the C-suite, PERSONALLY. VPs and up pay, personally. Let’s call it 1 million per deleted email. Even Elon Musk would get wrecked on that one.

Thing is, chat messages are extremely difficult and time consuming to review. Unless there’s something really bad in them, it makes more sense to screen for privilege and then bury the other side in millions of them.
