NYC Defies Supreme Court, Creates Times Square “Gun Free Zone”

On June 22, 2022, the Supreme Court issued the long-awaited and anticipated decision in the New York State Rifle and Pistol Association v. Bruen case. The decision ended more than a decade of silence by the Court as lower courts eviscerated Second Amendment right restored by the Heller and McDonald decision in 2008 and 2011, respectively.

Bruen decisively restored the right to carry portable arms outside the home and clearly ordered lower courts to abide by the standards of the Heller and McDonald decisions rather than use the “two-step” process the lower courts had established to evade the restoration of Second Amendment protections.

Governor Hochel of New York reacted within hours of the Supreme Court decision in Bruen with an emergency session explicitly designed to void the effect of Bruen.

On October 3, 2022, a federal district judge in New York found most of the “emergency” New York law to be unconstitutional, specifically a portion forbidding the legal carry of firearms in Times Square. From that decision:

Based on the historical analogues located thus far, it does not appear permissible for New York State to restrict concealed carry in the following place: “the area commonly known as Times Square, as such area is determined and identified by the city of New York; provided such area shall be clearly and conspicuously identified with signage” (as stated in subsection “2(t) of the CCIA).

On October 11, 2022, the City of New York defied the Supreme Court and the federal district court by imposing a City law banning the legal carry of guns by ordinary citizens in Times Square, with local law 0602-2022. The local law is to take effect immediately.

There will almost certainly be challenges to the law in short order.

New York State and City governments are openly defying the Supreme Court.

I predict the Court will win, but it will take some time, perhaps as long as a year or two.

Until that changes, the law is whatever Deep State thinks it can get away with saying it is.

So....nyc can defy the court and the law but what happens when the average law abiding American citizen walks into times Square and open carries? Laws are only good for a just society...not a just us society. Not pretty but pretty simple.

This is similar to the way Brown vs Board of Education was ignored by many states for years. It’s oddly clear just how important firearm fascism is to deep blue states.

That applies to one of NYC's other crazy laws that make it a felony to carry on the premises of a private business unless they have a sign posted allowing concealed carry.

In the past, concealed carry was allowed on private property that provided public accommodation unless there was a sign posted prohibiting concealed carry.

NYC turns that practice on its head.

50+ years ago, when I joined the struggle to restore Second Amendment protections, I never would have predicted:

No permit would be needed or open or concealed carry in 25 states by 2022,

that shall issue would be the law of the land in 42 of 50 states,

the Supreme Court would rule the New York Sullivan law was unconstitutional.

I have been fighting on this issue for 50 years+

We are winning, and the Second Amendment is the tip of the spear bringing back a functioning republic, if we do our part.

Americans should defy NYC by never visiting Times Square, or NYC in general. If the crime doesn’t wake them up to the solution, then maybe a little economic reality will.

That is the issue. We are supposed to be a Republic, the rule of law, not the rule of man.

As you said...when the rule of law is not binding, we are not a Republic.

You make an excellent point, but to me, this is an even bigger issue than the 2nd Amendment, as hard as that is to believe.

This is striking an open and public blow to the very fabric of what makes this country work, that is, being a real and actual republic and the Federal, State, and Local flaunting of legally passed law.

And what are the consequences to the people in the government of NY if they simply ignore the supremes ruling? Near as I can tell none. The problem is that there are no consequences to government officials who deliberately and knowingly violate the constitution.

Then it is incumbent on real Americans to let NYC deteriorate into the worse imaginable hell hole so at a minimum these socialists and Commies live in abject misery. We can start in January by cutting off all federal funding to sanctuary cities.

Will there be massive Gun Police presence observing and attempting to reduce freedom of movement in Times Square?

SCOTUS should:

A) strike it down

B) Assume the state of NY will act in bad faith and require them to get pre clearance to pass any gun regulations at all.

SCOTUS has done this before when they found states were thumbing their nose at the SCOTUS and violating people’s constitutional rights. This is the same thing.
