It’s already written into the State Constitution that he cannot voluntarily resign to escape impeachment without full filling the terms of his election time . Article IV section 1 of the State Constitution states:
“The executive power shall be vested in the governor, who shall hold office for four years...”
It doesn’t say can, it says shall. If he fails to remain in office for any reason other than death or criminal actions, by the way this is written, he cannot do that with the word “shall.”
It is within the State Constitution that if he is incapacitated and cannot serve, it is within the duties of the lieutenant-governor to assume office. But no where does it say he can resign or purposely fail to complete the term of four years or any following terms of four years he is elected to serve.
Now, whether the state legislature accomplishes what they are contractually required to do is up to the state. And that would be to not allow him to resign and prosecute the impeachment process. He remains governor during this just like Clinton and Trump were president during their impeachment process.

You could have a 90 day “cooling off” period. If the Governor leaves office during that period, then the clemency order is automatically rescinded.
You missed the point of the sentence you copied. He didn’t reach impeachment because he resigned which he can’t legally do as per the state constitution article I displayed. The state folded up and let him so he could escape impeachment violating the state constitution edits.
And you’re saying that because impeachment is being brought up that it is just talk? What is your information? If it is on the horizon, it’s there. They wouldn’t bring it up if they were that smart as they were willing to allow him to illegally resign. That makes them look twice as stupid.

He was not impeached. As far as I know (I am far from NY), there wasn’t even an article of his impeachment introduced. When I say there was ‘talk’ of his impeachment, ‘talk’ is like there is ‘talk’ of Trump’s being indicted for crimes. There is talk, but no indictment has been handed down.
Please don’t misunderstand. I have no doubt Cuomo is prime example of a crooked politician who was allowed by the dems in NY to wriggle away from what looked like certain impeachment and embarrassment to the party that holds power in NY.
The fact that legislature chose to focus on his touching women instead of sending 10s of thousands of elderly to their deaths tells me (and I’m sure you) how phony the whole Cuomo process was.
