Missouri County Passes Rule to Arrest Federal Officers Who Violate Second Amendment

A Missouri County has passed a rule to arrest any federal officer who tries to take away the Second Amendment rights of any of its citizens by trying to enforce any anti-gun laws coming out of Washington D.C.

As Daniel Horowitz of The Blaze wrote:

On Feb. 3, the Newton County, Missouri, Commission passed a bill that will not only block federal enforcement of unconstitutional gun policies but criminalize their implantation thereof within the jurisdiction of the county.
The “Second Amendment Preservation Act of Newton County Missouri” declares that “all federal acts, laws, orders, rules, and regulations passed by the federal government and specifically any Presidential Administration whether past, present, or future, which infringe on the people’s right to keep and bear arms as guaranteed by the Second Amendment of the United States Constitution and Article I, Section 23 of the Missouri Constitution shall be invalid in the county.”

The section of the Missouri Constitution that pertains to the rule reads:

That the right of every citizen to keep and bear arms, ammunition, and accessories typical to the normal function of such arms, in defense of his home, person, family and property, or when lawfully summoned in aid of the civil power, shall not be questioned. The rights guaranteed by this section shall be unalienable. Any restriction on these rights shall be subject to strict scrutiny and the state of Missouri shall be obligated to uphold these rights and shall under no circumstances decline to protect against their infringement.

The new rule in Newton County targets any federal policies that might order tracking and registration of firearms and ammunition that the Democrats have been introducing in D.C.

Horowitz ads that section 4a of the Newton County ordinance grants the sheriff’s department “full authority to make an arrest of any and all federal agents that violate state laws and enforce regulations” that violate the Second Amendment.

Finally, the ordinance bars anyone “who enforces or attempts to enforce any of the infringements identified in this ordinance” from “being hired as a law enforcement officer or to supervise law enforcement officers in the county.”

This will be the only way that regular people can fight these power mad leftists infesting Washington. We have to take back our country at the local level. Nullifying illegal federal laws at home. That is what we must do.

I love it.
All red states should pass such laws.
Let the Biden Gestapo take them to court if they don’t like it.

There is a state bill...but counties get things done faster.

Hope this turns into an avalanche, like the hole in the fence that brought down the Eastern Bloc!

States will rebel against the US government over their citizens rights under their Constitution.

Under the Civil Rights Act of 1965 government officials are not exempt. If they violate the constitutional rights of an individual they themselves are subject to arrest. 2nd Admendment is still part of the constitution. Suspect if there is push on both sides, things will get really interesting. However long before the issue works its way through the courts, shooting will have already will have commenced.

Given who’s currently heading the military? All of them, I’d say.

This law feels emotionally satisfying to me, but I think it’s impractical. The Federal government isn’t going to allow counties or states to arrest their people. The first step will be cutting off all Federal funding to anyone who enacts the policy. That will economically devastate whoever tries it. After that, I think they’ll show up in such massive displays of force that no arrests would be possible without bloodshed, and nobody’s going to do that.

I do think that having state and local laws nullifying unconstitutional Federal gun laws are good, and I think state and local laws barring any state or local law enforcement from assisting the Feds in enforcing such laws are also great to have. You can’t stop the Feds from doing what they want to do, but you can stop helping them. That actually makes a big difference as the Feds don’t have the resources to do all the ground work themselves. They count on local cooperation. Take that away and their operational capacity is greatly diminished.

All of them whenever a leftist priority is at stake, as per the "woke" DoD ...

I don’t get it. There are plenty of States that ignore any number of Fed Laws, like Illegal Immigration, Marijuana, and other drugs. No problem there. So why would there be a problem ignoring other laws.

What are these magical laws and Constitution you speak so highly of ?

If they were real, then how could a former Republican President get impeached while out of office while a Democrat Federal judge who was impeached, convicted, and removed from office for bribery currently have a seat in the House ?

So when 60 guys from ATF and the FBI show up with full tactical gear, helicopters, and sharpshooters, the local sheriff is going to start shooting with his revolver?

Yeah, I don’t think so. The local sheriff is going to show up and tell them to please go away. They’re going to ignore him and do what they want to do. But they can’t show up with 60 guys to every raid they want to do. So they’ll have to pick and choose a much smaller number. But those raids will absolutely happen and nobody’s getting arrested from the Feds at them.

“How many Divisions does he have?”

I’m thinking the same. While this certainly sounds good, and I wish them the best, people are SERIOUSLY UNDERESTIMATING the power of the federal government. The question will be very simple: How much pain is this county and Missouri ready to take accept to protect the Second Amendment. I can think some tools off the top of my head that will get the attention of state/county leaders, if they fail to comply - such as seizing their bank accounts and their property, for starters. The feds can do all that from DC, if they wish.

Impeaching someone while out of office is unconstitutional.

However, Hastings punishment was limited to removal from office, not disqualification.

Disqualification from holding office is not automatic with impeachment. The House Articles have to specifically request that remedy and the Senate has to vote to affirm it.

That wasn’t done.
