Dem Strategy Taps Courts To Pick Winnrs

One of the top lawyers in Bush v. Gore says the onslaught of lawsuits filed by Democrats this election year is a “nationwide coordinated effort” to attack state laws that “guard against voter fraud.” And, he says, their goal is to let lawyers and courts — not voters — pick the election winners.

Jim Bopp developed the legal rationale the Bush team used to argue and win its case before the U.S. Supreme Court in 2000. Today, he’s watching as Democrats, led by their election lawyer Marc Elias, have filed more than 400 election-related lawsuits in this cycle.

Elias, Hillary Clinton’s 2016 campaign attorney, is the founder of Democracy Docket, which describes itself as “the leading platform for progressive advocacy and information about voting rights, elections, redistricting and democracy.” It’s behind dozens of lawsuits across the U.S. that pressured states to change their voting rules as the November election approached.

The final step in the Democrats’ process, Bopp says, was to drive the election into the courts.

“The lawsuits leading up were preparing the way by striking down as many anti-fraud protections as possible and radically expanding the number of mail-in ballots either through universal mail-in balloting or expanding absentee and then creating opportunities afterward for litigation that throws the determination of the results into the hands of election officials, lawyers and ultimately courts,” Bopp told InsideSources.

The Trump campaign filed suit to stop what it says is an illegal vote-counting process in Michigan and Pennsylvania until the campaign could be granted “meaningful access” to observe the opening and tallying of mail-in and absentee ballots. They also filed suit in Georgia, asking that state laws be followed in the processing of absentee ballots.

Suits filed by Democrats in Pennsylvania had succeeded in striking down laws requiring mail-in and absentee ballots be received by Election Day and requiring a visible postmark, to prove they were mailed by Election Day.

“What this does is provides for opportunities for people to game the system,” says Bopp. “They get to find out how many votes they need. And then, they have three or four days to get people or dummy up ballots, make sure they’re mailed so they won’t have a date stamp.”

Bopp says Democrats were pushing for prepaid envelopes for ballots, not because they think their supporters can’t afford a 50-cent stamp, but because prepaid envelopes aren’t marked with a date stamp and therefore can be mailed after the election and still be counted.

“Of course the Republicans have filed suits,” he says. “But they’re all defensive. What Republicans are doing is trying to defend legislative laws that have been enacted, that the Democrats are trying to change, or have changed.”

Other suits around the country have challenged laws requiring witness signatures, or requiring signatures on ballots to match signatures on file with elections offices. Others have forced counties to put up unattended drop boxes and open additional voting locations.

The first suits were filed by Democrats in 2018, in the run-up to the presidential election.

“They were just practicing, and developing legal theories and things like that,” says Jim Bopp. “They also filed some suits this year prior to the primaries, and there were probably 40 or 50 of those … . But you know they didn’t care about the primaries. They were practicing and developing their legal theories but also trying to knock down some key provisions or paving the way for universal mail-in balloting.

“They had some success in that, but the big payoff was going to be this general election, and that’s why there’s over 400 cases.”

The end goal with all the Democrat lawsuits, he says, is the high court.

“You don’t do one Florida. You do 20 Floridas,” he says. “And why not?”

Scary. I just hope the Trump Team was aware of this effort, and has planned for it.

I believe that their strategy all along was to sew so much chaos that they would force it to SCOTUS. Then Ginsburg assumed room temperature and ruined everything. But, the train was way too far down the track to turn around.

This is the problem. When the Republicans have power in the legislature, they fail to pass anti-fraud measures. This occurs at both the state and national level.

From January 2017 to December 2018 we had a Republican majority in both houses of Congress and a Republican president “Trump” who would have signed any legislation passed. What meaningful legislation was passed during that time other than the tax bill?

At some point all of these niceties about working within the law to fight corruption in voter fraud and everything else the Rats are involved in will come to an end. Gonna have to fight dirty. Like right now.

Indeed, this might be the motivation for Ginsberg to hold on as long as she did (that is, holding on all of the way until her passing on) instead of resigning the court before she passed away.

No way do I trust the Supreme Court. Unfortunately the country was already too far gone when Trump was elected. We can see how millions of Americans have suddenly awakened this election to what is happening. Trump voters are anything but just White. So many of all races and creeds have joined his ranks, wanting to save our freedom.

But the fix has been generated for over four years to the most minute detail, and only miraculous help from all our prayers can save our country from this coup.

If we lose the two Georgia seats, expect the democrats to change to 51 seats for bill passing and they will pass an election bill ensuring that republicans never win again. It’s gett close already anyway at the presidential race.

Maybe a majority in the Senate, but NOT the 60 vote majority needed to pass legislation, at least according to rules that have been in place for over 100 years.

The thing is, the constitution makes it very clear. State legislatures determine who won and select the electors to send to the electoral college - not the courts.

For example, a judge could set aside ballot security measures. Then the legislature could just say “no. We don’t think so. Therefore we determine those ballots are not valid and the other candidate wins the election.” And there isn’t a single thing any court could do about that.

You operate on the assumption that the GOPe wants to eliminate fraud. They don’t. They are complicit. Paul Ryan was *never* going to let that happen. He is part of this!

Also, it’s funny how Paul Ryan is hired by Fox News and they pull their first ever stunt with the rest of the MSM to harm Trump’s re-election chances.

I agree with you that they *could* have at least brought it up ... but it wasn’t going to pass.

It has happened in many states which are now one party and the election laws have been rewritten (allowing vote harvesting, moving to mail-in, motor voter registration for non-citizens, general election limited to the top two primary vote receivers no matter what party) to ensure elections will always be dominated by Democrats - California, Washington, Oregon, and Colorado are there. Nevada and New Mexico are close. As soon as Georgia and NC get Democrat majorities in the legislature with a Dem government you will see the state election laws changed to allow vote harvesting, universal mail-in voting, and top-two primary in the general election). Florida and Texas are the big prizes.

Actually Georgia should immediately pass bills making elections fair. They still have time before January. I think we still have a state majority in the house and senate with a republican Governor. I think the should do it first day back in session.

The GOP Senate is already taking about an infrastructure bill for BIDEN. Something Trump wanted and they REFUSED to do. With Republican’s like that who needs Democrats?

There is no "right" of the people to cast votes for a President.

The States created a "privelege" for the people to cast such votes, but that "privilege" has been abused by local politicos in Democrat areas.

WI, MI, PA, NC, GA have Republican legislatures. NV has a Dem majority legislature.

The State legislatures can choose the electors, per the US Constitution, in light of the abuse. The courts have no standing.


THE UNITED STATES CONSTITUTION

Article. II.

Section. 1.

Clause 1: The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term, be elected, as follows

Clause 2: Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.

Clause 3: The Electors shall meet in their respective States, and vote by Ballot for two Persons, of whom one at least shall not be an Inhabitant of the same State with themselves. And they shall make a List of all the Persons voted for, and of the Number of Votes for each; which List they shall sign and certify, and transmit sealed to the Seat of the Government of the United States, directed to the President of the Senate. The President of the Senate shall, in the Presence of the Senate and House of Representatives, open all the Certificates, and the Votes shall then be counted. The Person having the greatest Number of Votes shall be the President, if such Number be a Majority of the whole Number of Electors appointed; and if there be more than one who have such Majority, and have an equal Number of Votes, then the House of Representatives shall immediately chuse by Ballot one of them for President; and if no Person have a Majority, then from the five highest on the List the said House shall in like Manner chuse the President. But in chusing the President, the Votes shall be taken by States, the Representation from each State having one Vote; A quorum for this Purpose shall consist of a Member or Members from two thirds of the States, and a Majority of all the States shall be necessary to a Choice. In every Case, after the Choice of the President, the Person having the greatest Number of Votes of the Electors shall be the Vice President. But if there should remain two or more who have equal Votes, the Senate shall chuse from them by Ballot the Vice President. (See Note 8)

Clause 4: The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States.
