Pennsylvania girl, 15, sues her school district after she was suspended for wearing pro-Trump gear in class

A 15-year-old Pennsylvania girl is suing her local school district after she was suspended for wearing a ‘Women for Trump’ face covering and a ‘Trump the Sequel Make Liberals Cry Again’ t-shirt.

Morgan Earnest, a sophomore at Mifflin County High School in the central Pennsylvania town of Lewistown, says in a lawsuit filed in federal court that her free speech rights were violated by school administrators.

On October 1, the school district issued a new policy on clothing which banned students from wearing anything that contained political messaging, The Patriot News reported.

We all know full well that the school district CANNOT prohibit political speech (this includes T-shirts) unless the school district has a uniform policy. Girl will win.

As a term of her lawsuit, those who banned her can never be in that position again. If they don’t grasp the personal liberty, they don’t belong anywhere near students.

In the article, it did say that the ban includes movements such as BLM logos and and clothing...

Starting Monday October 5, 2020, no masks, articles of clothing or other items may be worn or otherwise brought to Mifflin County School District property, which contain political speech or symbolize a particular political viewpoint, including but not limited to confederate flags and swastikas, as well as BLM logos or phrases associated with that movement,’.

I personally have no problem with schools establishing dress codes, as long as they are done uniformly. The kids are supposed to be there to learn the three R's, not engage in fashion shows and political pissing contests. You interested in politics? Join the debate club. This of course is the ideal, as we know that they are being indoctrinated with leftist propoganda.

Well, right, since that’s never going to happen, so me the punishment for a Black Lives Matter shirt...

Oh, right, that’s not political.

It’d be awesome if someone pulled up in front of the school and offered free Trump shirts for any students who want to wear them into class. Let’s see how many suspensions can be set up...

Mifflin County is conservative. But like ALL schools, their schools are run by leftists and have tons of leftist teachers.

I think that the SCOTUS ruling in Tinker vs. Des Moines School District might have application here.

That SCOTUS opinion established that students "do not shed their constitutional rights to freedom of speech or expression at the schoolhouse gate" and that student speech cannot be censored unless it "materially disrupts classwork or involves substantial disorder or invasion of the rights of others."

Since that decision, there have been some others that have chipped away at students' right to free speech, establishing that it's not absolute when it comes to schools, but this case is far more similar to the Tinker case than it is to any of the subsequent cases. Tinker was about students wearing black armbands to school to protest the Viet Nam war. Subsequent cases have been decided against students who advocated illegal activity, who used sexually offensive speech, and who wanted to print "inappropriate" content in the school-sponsored paper.

But it's pretty well established that students have a right to wear things advocating a political point of view.
