Portland sues federal government over protest response, 'commandeering' of police force

The cities of Portland and Oakland filed a federal lawsuit Wednesday, accusing the Department of Justice and Department of Homeland Security of unconstitutionally taking over law enforcement responsibilities in the two cities under policies implemented after President Trump signed an executive order to protect federal monuments in June.

The cities sued the departments' leaders, Attorney General William Barr and Acting DHS Secretary Chad Wolf, in their official capacities as well and asked the judge to forbid the federal agencies of sending officers to the cities. The 48-page lawsuit was filed in federal court in California.Among the allegations, the cities said the federal government's policies to send in officers to protect federal property instead "reveal a distinct and meaningful policy shift to use federal law enforcement to unilaterally step in or replace local law enforcement departments that do not subscribe to the President’s view of domestic “law and order.”"

The lawsuit said Barr and Wolf "did not seek Portland’s consent" in sending federal officers to the city in early July, and further, "defendants did not act at the direction of PPB incident command that had been policing nightly protests for over a month" when they were in town.

Portland and Oakland city attorneys asked a federal judge to rule the practice of sending in federal officers unconstitutional and pointed to the recent federal deputation of Portland police officers as an example of the federal government "commandeering" local law enforcement, despite requests from local leaders to de-deputize the officers.

I have made mental predictions about the name of the federal judge who sides with the cities.

I decline to share my thoughts because everyone here is thinking the same thing.

Dear folks in Portland,
The city leaders love your pay-to-them tax money, but they care not if you live or die!

Time to leave!!

Then maybe those guys in Portland are saying they don’t want any more Fed money for construction or maintenance of projects, statues, buildings, facilities, parks, etc.

Partner, I would immediately say that this federal judge needs to be fired asap.

Nope, let the liberals live in the nest they soiled. They are like a disease, spreading their lies and garbage wherever they go. e.g. Colorado and Arizona.

We must have missed the passage in the U.S. Constitution that says the cities of Portland and Oakland are outside of US jurisdiction.
Maybe it’s all cities that have “land” in their name.

"We want burning, looting, and murder, not the rule of law! So, we'll use the rule of law to SUE Trump!"

Complete. Insanity.

"The lawsuit said Barr and Wolf "did not seek Portland’s consent" in sending federal officers to the city in early July, […]"
FR: Never Accept the Premise of Your Opponent’s Argument

Yes, under the Constitution, state governments need to officially request help from the feds to help suppress domestic violence.

"Article IV, Section 4: The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence [emphasis added]."

H O W E V E R…

Constitutionally low-information Portland city government leaders don’t seem to understand (blatantly ignore?) that the Founding States also gave the feds the express power to suppress insurrections (violence against government), no permission from renegade city or state government leaders required, although feds ultimately need to provide evidence to Supreme Court to justify actions imo.

"Article I, Section 8, Clause 15: To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections [emphasis added] and repel Invasions;"

Insights welcome.

Send "Orange Man Bad" federal and state government desperate Democrats home in November!

Supporting PDJT with a new patriot Congress and state government leaders that will promise to fully support his already excellent work for MAGA and stopping SARS-CoV-2 will effectively give fast-working Trump a "third term" in office imo.

I don’t see any problem with voting Republican ticket for 2020 elections.

Again, insights welcome.

I sure the federal can just take over Federal properties like Federally paid buildings and highways.

The government of those citties are in rebellion to their assigned function of upholding the law and maintaining order, and their state governor is apparently complicit, not dealing with these offending cities with state police and/or the state's National Guard.

So what are they thinking to do if the federal officers step in in defense of the ordinary law-abiding citizen to secure his/their liberties under the Constitution and that of their state?

Do these cities think they can secede, taking with them their decent citizens and their property?

U.S. taxpayers need to be reimbursed by the City of Portland as no “Sanctuary City” has any right to sue anybody for non-compliance with existing law.

This is hilarious.

“Your honorship, the federal government overreached when it interfered with our God given Constitutional rights to allow our citizens to execute each other in the streets and burn our cities to the ground.“

It’s made all the more amusing when you consider that the dems are suddenly all about states’ rights.

How can anyone keep a straight face anymore?

They filed suit in the New Supreme Court - the Northern District of California, where district judges outrank Supreme Court justices, and magistrate judges outrank the President of the United States...

Looks like this will probably go to duty station Oakland:
