Rumors Swirl: Supreme Court Justices Samuel Alito, Clarence Thomas May Retire

Supreme Court Justices Samuel Alito and Clarence Thomas may be planning to retire soon, according to rumors in the media Wednesday.

Robert Costa reported in the Washington Post that the Trump administration was preparing for the possible retirement of Justice Clarence Thomas:

Justice Clarence Thomas, a conservative appointed by George H.W. Bush, is privately seen by Trump’s aides as the most likely to retire this year. While Thomas has not given any indication of doing so, the White House and Senate Republicans are quietly preparing for a possible opening, according to a White House official and two outside Trump political advisers who spoke on the condition of anonymity to discuss the private conversations.

In response to that article, Hugh Hewitt stated on the Hugh Hewitt Show that he did not believe Thomas would retire, but that he had been told Alito was considering retirement.

Hewitt said, as the Washington Examiner reported:

Hewitt suggested he learned this rumor when “people begin working the refs” this time of year.

“I’m hardly a ref, but I got a column in the Washington Post, and so they start working me about, ‘You know this person would be great if Alito quit,'” he said.

Thomas is 72 and Alito is 70 years old.

In addition, liberal justices Justices Stephen Breyer (81) and Ruth Bader Ginsburg (87) are considered candidates for retirement.

Therefore, it is possible that whoever is president for the next four years could have the opportunity to make four Supreme Court appointments.

They are allowed—the “nuclear option” simply allows cloture by “majority vote” instead of 60. A couple of Republicans could allow a Democrat filibuster even if they aren’t willing to vote against the nominee.

A bit of trivia: The text of the rule was actually never changed.

Well the current SCOTUS term ends today, and the last day is traditionally when retirements are announced. I was hoping RBG would give it up today.

Such a dumb take. Alito and Thomas are the two most rock solid conservatives on the court. I’m not sure either one has ever voted with liberals on any issue of importance.

Why not six months ago? Would be hard to replace now, just a couple months before the election.

But the prospect of two appointments in the next term would be a campaign issue that might bring out Conservatives.

Biden would go with a Kardashian, Cuomo, Kamau Bell, Oswalt Patton.

Why not six months ago? Would be hard to replace now, just a couple months before the election.

It is customary for SCOTUS judges to retire at the end of a term in June. The next term does not begin until October, so in a well-functioning Republic, there would be plenty of time to confirm an appointment.

But we don't have a well-functioning Republic.

Alito and Thomas are both younger than Trump, Breyer and RBG. They are the best two on the court and should stay on through 2024. Certainly unless Trump can be assured that his new nominee would be confirmed before January.
Another big government left-wing justice who makes up their own Constitution could imperil the rule of law for a long time.

How long did it take between the time Ballsey released her letter and Kavanaugh was confirmed? The rats are vicious. Expect them to throw multiple monkey wrenches in each nomination.

This is a political announcement. It is there to gin up support for both candidates. D’urkas think WE HAVE AN OPPORTUNITY HERE, R’s think, we MUST keep the Senate and POTUS.

Very unlikely unless there is a pressing reason (i.e. some serious health concern). It’s July in a presidential election year. The Dems would burn the capitol down before they would allow Trump another SCOTUS appointment before the election. Like it or not, it would be very very difficult to get anybody confirmed before the next Congress is seated.

Yes. What if RBG is so overcome by the sudden departure that she keels over from the stress and doesn’t recover?

Elizabeth Warren, Gretchen Whitmer and Stacey Abrams.
