US Attorney in Manhattan refuses to resign after Barr announces that he’s ‘stepping down’ (Berman)

n a stunning plot twist, U.S. Attorney Geoffrey S. Berman issued a statement Friday night asserting that he will not, in fact, resign — in direct contradiction to an announcement that he was stepping down made hours earlier from Attorney General William Barr.

“I learned in a press release from the Attorney General tonight that I was ‘stepping down’ as United States Attorney,” Berman, said in a statement posted to the Southern District of New York Twitter account.

“I have not resigned, and have no intention of resigning, my position, to which I was appointed by the Judges of the United States District Court for the Southern District of New York,” Berman’s statement continued.

President Trump was been too tardy in draining the swamp at the DOJ. Sessions had something to do with it yes, but Trump could have done a lot more to get rid of these guys long sgo.

he can find to discredit Trump. You can bet fatboy Nadler and Pelosi

have their fingers all over this...

This is what happens when you try to give a lefty a break.

Look at Mick Mulvaney, his first response to the Trump/bolton was to say that Trump doesn't know how to hire people.

Trump has hired thousands of people to run his businesses, and became a billionaire because of his ability to read people.

The thing that Trump had not figured out was that DC swamp critters are not human, they are lower than pond scum.

Your question: Where did this idiot get that idea?

My answer: He got that idea because it’s true. After Trump sacked Bharara, Sessions appointed Berman as the interim U.S. Attorney, an appointment not requiring Senate confirmation.

The catch is that the interim appointment lasts a maximum of 120 days. 28 U.S. Code § 546(d): “If an appointment expires under subsection (c)(2), the district court for such district may appoint a United States attorney to serve until the vacancy is filled.”

That’s what happened here. Trump and Sessions never sent a nomination to the Senate. With the interim appointment nearing its expiration, the judges appointed Berman so that the office could continue to function. Under the statute, Berman is in until Trump nominates a successor and the successor is confirmed by the Senate.

I think there’s more to this story than meets the eye. It looks to me as if Trump and Barr deliberately picked this fight — and Berman took the bait.

Berman is refusing to leave by claiming that his “temporary” appointment by the judges in that U.S. District is effective until the U.S. Senate confirms his replacement. AG Barr announced last night that SEC chairman Jay Clayton would replace Berman ... and under Federal law he can serve in an interim capacity in this role because as SEC chair he was already confirmed by the U.S. Senate.

So did Barr make the announcement without getting the guy’s agreement—or did the guy agree and then reneg?

Either way Dems on Twitter last night were jubilant with the idea that this would force a couple of GOP Senators facing tough reelections to cast a vote for the guy’s replacement that would cause them to lose their seat and Trump to therefore have just lost the Senate on them.
