I think there’s more to this story than meets the eye. It looks to me as if Trump and Barr deliberately picked this fight — and Berman took the bait.

Berman is refusing to leave by claiming that his “temporary” appointment by the judges in that U.S. District is effective until the U.S. Senate confirms his replacement. AG Barr announced last night that SEC chairman Jay Clayton would replace Berman ... and under Federal law he can serve in an interim capacity in this role because as SEC chair he was already confirmed by the U.S. Senate.

Because of Senate inaction/collusion, Trump is limited to the pool of loyalists already confirmed?

Makes me wonder how McConnell is getting all these judges confirmed, considering that we cannot seem to count on Senate confirmations for other positions?
