Ex-judge urges court to sentence Michael Flynn despite DOJ bid to drop case

A former judge appointed to oppose the Justice Department’s request to drop its case against Michael Flynn urged sentencing to move ahead in a court filing Wednesday, arguing the government’s request to dismiss the case has only “pretextual” justification.

Ex-Judge John Gleeson said in a DC federal court filing that “[t]he facts surrounding the filing of the Government’s motion constitute clear evidence of gross prosecutorial abuse. They reveal an unconvincing effort to disguise as legitimate a decision to dismiss that is based solely on the fact that Flynn is a political ally of President Trump.”

U.S. District Court Judge Emmet Sullivan appointed Gleeson, a former U.S. district court judge in New York also known for handling mafia cases as a prosecutor, to oppose the Justice Department’s request to drop the case. Both Sullivan and Gleeson were nominated to be judges by former President Bill Clinton.

Gleeson was never intellectually, ethically, or morally qualified to be a judge, and this recommendation proves it beyond the shadow of a doubt.

Are not judges supposed to be impartial? Where the heck does he get off “appointing” a lawyer who doesn’t represent a party in the case?

No one would want this nothing case prosecuted had Flynn not briefly been in the Trump administration. No one can identify anything seriously wrong done by Flynn.

The spectacle of third parties demanding a guy be sentenced when there was prosecutorial misconduct is despicable.

U.S. District Judge John Gleeson was appointed by judge Emmet Sullivan to do just that, interfere with the dismissal of the case against Michael Flynn. Judge Emmet Sullivan is an egotistical slob who wanted to hang Flynn and when deprived the ability to do that, he tries to find a way to pull it off. He should be disbarred!

“The Appeals Court should end this farce.”

The appeals court would have ended this farce if the Law mattered to them but Orange Man Bad and the appellate court is in on it. ACTIONS speak louder than words.

As someone above pointed out, here we are almost two weeks into June.

This will still be on going in July...

The term is “embroiled,” when a judge becomes emotionally invested in a case. In nearly three decades before the bar I’ve never seen anything even remotely close to the embroilment here

This is a sham trial. Judge Sullivan has declared Flynn guilty even though the government has said no crime was committed. If this travesty is reversed on appeal, President Trump should issue a pardon.

DOJ brought a single charge, lying to the FBI. He was never charged with the crimes alleged in the initial investigation. Flynn pleaded guilty because of a threat to bring charges against his son, the FBI threatened Flynn to force a plea. The trial portion never happend, the case moved to the sentencing phase. Before he was sentenced, the DOJ discovered the misconduct by the FBI and moved to dismiss the charge in the interests of justice. Both parties, the government and Flynn agree that no crime was ever committed and therefore should be dismissed. The Judge must dismiss the case, the Constitution and Judicial rules require him to do this. He is engaged in a political vendetta that cannot be allowed to proceed. Judge Gleasson's argument makes no sense and is nothing but a political screed. Saying that because of prosecutorial misconduct in this case, the Judge should sentence the defendant to a crime he never committed and only existed because of the very prosecutorial misconduct cited. Only in an Alice in Wonderland world, in other words, the world of the Democrats, could this even be contemplated.

Sullivan is black and left-leaning, so I have no doubt that he is taking orders from the law-less firm of Obama, Holder and Jarrett.

I wonder who the judge thinks will incarcerate General Flynn is he does sentence Flynn to jail time? The DOJ runs the federal prison system. If Flynn is sentenced for lying to the FBI, then I liked to see Barr refuse to carry out the sentence and let Flynn go free. Gleason by the way argued against a contempt of court sentence for Flynn for knowingly pleading guilty to a crime Flynn knew he didn’t commit, a patently laughable legal theory in itself.

When the ex-Judge presents 82 pages of drivel written by the attorneys being paid by the Democrats, you know he has no facts and hopes that 82 pages of drivel will influence the court.

So, when Flynn is sentenced, which would not surprise me, then what?

There are several issues before the court.

If Flynn is sentenced there will be an appeal.

Then the justice department says, there never should have been a sentence, because there wasn't any crime.

Then the appeals court dismisses the case.

I tend to agree that the point is to prolong this to keep Flynn gagged.

The idea of a gag order is repulsive.
