Dallas County commissioners vote to limit some of Judge Clay Jenkins' emergency authority

Dallas County commissioners voted unanimously on Tuesday to limit some of the authority for county Judge Clay Jenkins during an emergency.

The changes now require a majority of the county commissioners to approve any extension of the "safer at home" order beyond April 30.

Harris County (Houston) needs to limit its County Judge’s authority. The girl Hidalgo doesn’t have a clue.

I believe the governor’s latest order also reigned in some of the judges orders (e.g. Churches can’t be closed, but they can be limited to the number of people allowed at one time).

The judiciary adjudicates.
The legislature, legislates.
The Executive, executes.

The Judge has over stepped his authority by taking on both the executive and legislative roles in his actions. These actions have caused harm to citizens by denying them their civil rights protected under the US Constitution (exercise of religion, gathering and redress of grievance).

The remedy should be a /Class Action/ suit citing US Code Title 18, Section 242. All it takes is one hungry lawyer with the balls to take it on and solicit litigants.

I read the whole article - there was a good bit of weasel-wording trying to give Jenkins some cover. Just speculating but methinks Commissar Jenkins had some extended kooky stuff in mind, the commissioners got wind of it and moved to shut him down.

They need to require a judge in that position of authority to actually live in Dallas county.
He’s an arrogant stick that needs to be removed from office.

It had more to do with a previous action. He denied one of the other Commissioner’s request to open pawn shops. Didn’t go over well. He tried to walk it back Monday by designating pawn shops as essential but it was to late.

I remain suspicious, I know how pricks like that think. And the news never tells the whole truth - the spinny tone of the article alone raises flags. I still say he was prepared to step off into a world of stupid on his own and the commissioners weren't gonna have it.

The County Judge in Texas is the Chief Executive of the County, the presiding officer of the Commissioner’ Court, which is the County legislative body, AND the judge of Constitutional County Court. The office is derived from the Spanish “alcalde” and combines executive, legislative and judicial functions. In very populous counties the County Judge may disclaim judicial duties, but even if they do so the title remains.

Every disaster decree made by a County Judge in Texas is an exercise of Executive, not Judicial, authority.

He pissed off John Wiley Price. Told him that he was shutting down pawn shops and barber shops. Well, ol’ JWP don’t be puttin’ up with that b.s.
