Impeachment Witness Says Case Against Trump 'Collapses Under Weight of Time'

Democrats are demanding Senate Majority Leader Mitch McConnell call a list of witnesses the Democrats believe will bolster their impeachment case against President Trump. In their rush to impeach the president before the holidays, the Democrats abandoned their legal fight to subpoena the witnesses they once proclaimed were central to building their case. Now Democrats want a do-over in the Senate. 

Jonathan Turley, the Republican witness and legal scholar who testified before the House Judiciary Committee during the Democrat-led impeachment inquiry, wrote an op-ed explaining how the Democrats' weak case against the president is already collapsing as Senate Republicans continue to wait for Speaker Pelosi to transmit articles of impeachment.

As the House and Senate continue their struggle over the coming Senate impeachment trial of President Trump, a federal judge in Washington issued an opinion that was largely lost in the crush of New Year’s stories. The opinion could loom large in the trial, however, and one line in particular may be repeated like a mantra by the Trump defense team: “The House clearly has no intention of pursuing” the witness.

The witness was Charles Kupperman, a deputy to former national security adviser John Bolton. Other than Bolton himself, Kupperman is one of the officials most likely to have direct knowledge of an alleged quid pro quo involving aid to Ukraine. After subpoenaing him in October, the House mysteriously withdrew its subpoena before the court could rule on compelling his testimony. It also decided not to subpoena Bolton and other key witnesses. Judge Richard Leon dismissed the case just before New Year’s Eve with a hint of frustration, if not bewilderment, that the House did not seem interested in hearing from a possible eyewitness. Historically, that lack of interest in not just witnesses but a triable case will remain one of the most baffling blunders of this impeachment.

When I testified in the House Judiciary Committee’s impeachment hearing, I referenced the Kupperman case in my criticism of Democratic leaders’ pledge to impeach Trump by Christmas despite a clearly incomplete, insufficient record. While I opposed a number of proposed articles of impeachment that were subsequently dropped by the committee, I said Trump could be legitimately impeached on abuse of power and obstruction of justice if the House could establish such violations. The House, however, refused to wait just a couple of months to build a much stronger case for Trump’s removal. In its mad rush to impeachment, the House could not have made it easier for the White House.

Turley correctly points out that "[t]he House impeached Trump before that court or other courts could rule on the merits of claims of presidential privileges and immunities. Both Clinton and Nixon were able to take such challenges all the way to the Supreme Court before facing impeachment."

Democrats rushed impeachment because the polls confirmed that the more Americans learned about Trump's handling of foreign aid to Ukraine, the higher Trump's approval numbers climbed. Now, Democrats want to paint Mitch McConnell as the one responsible for the weak impeachment case against the president when it was the House's decision to rush the articles before the holidays.

I’m thinking maybe the next thing the United States House of Representatives, led by the Democrats, should waste time and money on is a vote on whether Michelle 0bama is prettier than Melania Trump.

It would carry the same amount of weight and prestige as their impeachment endeavors.

The Mueller investigation was purposed to dig, legally, into every aspect of Donald Trump, his family, his friends, his finances, his companies, his legal holdings, his lawyers, his accountants, his history… all of it… and they did so under both Title-1 and Title-3 surveillance authority; the Mueller probe was a counterintelligence operation (and tasked to cover-up all Democrat wrongdoing).

President Trump: travel records, phone records, electronic files, electronic communications, emails, electronic records, family files, medical records, bank records, tax records,… THE WORKS … all with unlimited surveillance authority as granted by former Deputy Attorney General Rod Rosenstein and the useful status of an unlimited counterintelligence operation. Think about the scale of the material Weissmann and Mueller gained access to? Think about the scale of these Trump files?


AND THIS It wasn’t just “wiretaps” Democrats gained from the fraudulent FISA, the scurrilous
Obama FBI requested and received full Title-1 surveillance authority of Trump including:

Leaked revelations showed then-FBI lawyer Kevin Clinesmith manipulated evidence to attain a Title-1 FISA surveillance warrant against Trump principal Carter Page to conduct political espionage against the Trump campaign.
