'The law is the law': Virginia Democrats float prosecution and National Guard for police who fail to enforce gun control legislation

Democratic lawmakers on Capitol Hill say local police who do not enforce gun control measures likely to pass in Virginia should face prosecution and even threats of the National Guard.

After November's Virginia Legislature elections that led to Democrats taking control of both chambers, the gun control legislation proposed by some Democrats moved forward, including universal background checks, an “assault weapons” ban, and a red flag law.

Legal firearm owners in the state, however, joined with their sheriffs to form Second Amendment sanctuary counties, which declare the authorities in these municipalities uphold the Second Amendment in the face of any gun control measure passed by Richmond.

Exactly!

And do any research into how totalitarian regimes were able to oppress and terrorize their people- it was through the police going along with the regime, and doing the dirty work.

It's not meant to offend, but this is why police, along with Congress, should be required to complete and pass a mandatory course on our Constitution, every 2 years, in order to continue in their jobs.

LEO'S do good work, but, Constitutional principles are not taught with any competence, (and haven't been for a long time), in our educational system.

I imagine most people couldn't pass a basic test on them. And this could leave the door open for potential Marxists or Democrats to start taking people's rights away.

As far as I know, the only way that they could coerce them to do it would be with warrants. That would be an expensive, slow and legally difficult process.

A governor can call the Guard out for state active duty, but he cannot “nationalize” it.

I seriously doubt the guard can perform LE duties. Remember the Posse Comitatus Act prohibits the military from performing arrests, searches and seizure and other critical LE activities. I am quite sure this Act applies to the national guard. The guard is relegated to working in a support role to LE. The State Police generally are confined to the roadways. That leaves the political appointed urban hacks - the police departments to run roughshod over their domain. The only LE force that matters in the county is the sheriff, at least those sheriff departments that were smart enough to retain their full Constitutional LE powers.

There will be no war. Neither the sherrifs, nor the national guard will obey the governor in large numbers outside of N VA. The state police may, for a while.

Northam, having failed to resign in disgrace when he should have, is going to get another chance if he chooses to enact and enforce this law.

Eisenhower did it when the governor of Arkansas tried to use the NG to enforce segregation in Little Rock.

But wait, the law’s not the law when it comes to illegals...

Either way, their plan to prosecute officers is laughable; not only do they have a zillion little immunities that protect them from it, they also have some solid SCOTUS decisions stating that law enforcement is optional for an officer.

In some cases, Guard members are “deputized” and given limited law enforcement authority.

My unit was mobilized as part of the Inaugural security in 2009, and we were all “sworn” and deputized for a 72-hour period
