The article implies he’s in federal custody but doesn’t actually state that.

How about charging him under federal codes for violations of (Steinle’s) civil rights?
They have used that tactic before, and it was successful. It was even in the 9th federal circuit.

He’s being charged on federal law violations, esp. as a convicted felon and a deportee. Nothing there conflicts with the state’s deliberately bungled prosecution.
You want this bastard walking the streets of any city? You’re the one who’s sick and dangerous, more than he is.
Hopefully his previous felony conviction will result in a greater sentence than if he had not been a felon. he’s a threat to society as long as he’s alive.
