Florida Man Who Fatally Shot Black Man During Parking Dispute Found Guilty

A white man who cited Florida’s “stand your ground” self-defense law after fatally shooting a Black man during a dispute over a parking space last year has been convicted of manslaughter.

Jurors in Clearwater, located roughly 25 miles west of Tampa, deliberated for six hours on Friday before announcing their verdict against Michael Drejka, 49, in the shooting death of Markeis McGlockton, reported the Tampa Bay Times.

Drejka’s attorneys reportedly plan to appeal the verdict after their client’s sentencing hearing, which has been scheduled for Oct. 10. He faces up to 30 years in prison.

The shooting occurred after McGlockton, a 28-year-old father of three, parked in a handicap spot outside a Clearwater convenience store in July 2018 while he ran inside with his 5-year-old son to purchase snacks, according to his girlfriend, Britany Jacobs.

“Stand your ground” is absurd, the guy was on his back. How was he going to retreat? I don’t think he used that defense at all. The press tied the thing to Florida’s law trying to discredit the concept.

I watched the video a number of times in slow motion. The victim never advanced after the gun came out.

The shooter was being an absolute dick.

So you get slammed into the pavement for telling somebody to park elsewhere?
The dead guy was the aggressor - he escalated the situation.
The shooter should have kept his yap shut....apparently he has a history of excoriating people who wrongly park in H/C spaces.

If the victim had known the perp was carrying, would he have shoved him?

In most cases, I think, no. But there are some individuals whose impulse control is so bad that I don't think it would have made a difference.

It annoys me as well to see people parked in handicapped spaces that shouldn't be. Especially those who think that "live parking" in one is an okay thing to do. (Do they expect a real handicapped person to rap on their window and ask them to leave?)

But I don't let it be my problem. I let law enforcement or hired security deal with those infractions. So this guy's life is basically ruined all because he took it upon himself to try and enforce a handicapped space. Sad.

There shouldn't have been any situation. Drejka was looking for trouble.

"Mind your business" - You'll live longer, or not get cornholed in prison.

Agree 110%. Virginia does not have a “stand your ground” law. To carry conceal the Commonwealth of Virginia hammers in the following to justify deadly force:
1. You’re an innocent bystander. In other words, you didn’t instigate or escalate the confrontation. In this case, the guy clearly instigated the confrontation.
2. You took reasonable effort to avoid confrontation. In other words, you called police and retreated to a safe spot. The guy certainly didn’t call the police and continued to escalate the confrontation.
3. If the person still confronts you continue to retreat and only when no longer able to back away may you use deadly force. The guy justified his action using “stand your ground”, but when put in context with #1 and #2 no surprise on the final verdict.

I confess that the whole “handicapped parking” thing is a bit of an annoyance for me.

Once, my wife went in to Costco to get our pictures (remember the days of film?). and all of the handicapped spaces were empty. So I backed into one of the close ones and waited for her. My car has no front license plate.

As I’m waiting, a guy walks slowly by my car with his family, closely studying my front bumper. He then walks around to the back of my car and looks at my plate. Then he comes up to the driver’s side window and knocks on it. I roll it down and he asks if I have a handicap sticker. I said no, I’m waiting for my wife. He tells me I can’t park in a handicapped stall. I tell him I’m not parked, I’m stopped, and I’ll move if the other five stalls fill up while my wife is in the store. He just sort of grunts and walks on.

There is a big difference between parked and stopped. A stopped car can move when it’s necessary.

he said that his ex mother in law was handicapped and it always bothered him when someone parked in a spot without proper tags.

It isn't that simple. He was in her face, yelling at her and acting as in a threatening manner. Her husband came out, saw it, and acted to defend her. Once he pushed him down, the victim stood his position and in the few seconds between the push and the shooting was clearly not threatening. The shooter got what he deserved.

The victim, however, tempted fate by physically confronting the guy when clearly he was only running his yap.


And that’s also a good bit of why it was manslaughter, and not murder. Both over-reacted. The shooter over-reacted twice.
