Why would you choose someone in his nineties to preside over a case? Makes no sense. A guy that age probably made frequent use of the "I'm so old I don't buy green bananas any more!" joke. Why would he be expected to last through a prolonged trial?

From his wiki page he looked like a good solid judge with a civil libertarian bent. He was semi-retired and I hope this wasn’t arkencide, because losing this guy is definitely a loss.

He was a civil libertarian in the good sense. We would be fortunate to have more judges like he was. The problem we have is that the ones who get promoted are often promoted because they can be counted on to rule a certain was. Think John Robert’s.
