Breaking: Trump Hits Dems with Census Curveball, Announces Plan To Circumvent SCOTUS

President Donald Trump announced Thursday he’ll be issuing an executive order directing federal agencies to provide the Commerce Department with records pertaining to “the number of citizens and noncitizens in our country.” Speaking to reporters from the White House Rose Garden, Trump said his administration is “not backing down on our effort to determine the citizenship status of the United States population.” While Attorney General William Barr said the citizenship question would not be included on the 2020 census, Trump detailed what his administration will do instead.

“I am hereby ordering every department and agency in the federal government to provide the Department of Commerce with all requested records regarding the number of citizens and noncitizens in our country,” Trump said, as ABC News reported. “They must furnish all legally accessible records in their possession immediately. We will utilize these vast federal databases to gain a full, complete, and accurate count of the noncitizen population.”

Ah … No. That’s not at all what was ruled. Such a ruling if it were made which it was not would invalidate more than 200 years of Census practice and policy as well as constitutional amendments addressing the subject. For example, Civil War amendments addressing the citizenship of Black Americans would be negated. Census questions included citizenship to directly address these amendments.

Here’s a chart showing more than 220 years of US history with respect to the census included citizenship or similar questions (Were you born in the US or any of its territories?).

That you are so far out of what is transacting makes me hesitant to engage any other comment you might have.

There are three broad categories of status:

Citizen
Noncitizen legals
Noncitizen illegals

Citizen accounting is fairly straightforward primarily by using tax data aggregation of families and dependents, individuals.

Noncitizen legals are easy enough for government databases to be processed for numerical counts. For example, H1B visa holders are a known quantity. Thus, this portion can be accounted for.

Noncitizen illegals are estimable using a variety of methods. For example, the roundup of more than a million illegals that is happening now is based on deportation orders that have been ignored.

I didn’t see the article. My comment was based on what I heard Barr say in his brief comments after Trump’s yesterday. I understand that just because it’s in court doesn’t mean the matter hasn’t already been settled. I also understand that Barr was supporting the president’s decision for the particular executive action that was taken. Whether or not Barr believes it’s settled law, I don’t know.

Sorry, I know what I wrote about. The Supreme Court ruled 10 or 15 years ago or so that everyone is included in the population count and is included in the apportionment.

I'm sure you can google it and find out.

I said I heard it yesterday too but nobody was listening. He said it would be a big fight with Dems but it’s doable.

One thing I see is in the total number of eligible voters. Surely this information will show how many illegals are in each state. If a state has more voting than registered voters, or a higher percentage than normal voting by citizens, that should raise a red flag for voter fraud, especially in blue states without voter ID.

Yeah, that info should definitely be in the info that Trump ordered be collected. How reliable those numbers are probably varies from state to state though. That’s a whole nuther problem.

Are undocumented residents (aliens) in the 50 states included in the apportionment population counts? back to top Yes, all people (citizens and noncitizens) with a usual residence in the 50 states are to be included in the census and thus in the apportionment counts.

The above is direct from the US Census website. It was easy to look up. Here is the link: https://www.census.gov/population/apportionment/about/faq.html#Q2

In addition, don't be so arrogant like you know everything. I think you need to go back and correct those you have misled and misinformed and let them know the correct information. Thanks for the history you gave me.

Let's assume that tomorrow 20 million people from Mexico flood into California.  This would make the population of California approximately 60 million, out of 350 million in total.  This would mean under apportionment they would have 75 seats, approximately, if that argument holds out of 435.

Ok, what if 200 million people were to flood into California over a 10 year period?  None of them are citizens and yet now one state, under that "read" of the Constitution as amended, results in it having forty-five percent of the entire House, or one hundred and ninety-six seats.

The entirety of the rest of the nation no longer has any representation at all; the entirety of the United States House is now beholden to and both can and will pass laws on the predicate and demand of non-citizens.

This outcome is patently absurd as to "interpret" the Amendment this way means we no longer have a nation that is bounded by the Constitution and its representative process in any form.  In other words this "interpretation" is an effective repeal of the entirety of the Constitution, not only as originally written but as amended.

That's absurd and thus cannot be the intent of the language in the 14th Amendment. - Karl Denninger

See #89. It is settled law. The SC ruled a decade or so ago that illegal aliens are included in the pop count and apportionment. And the answer is on Census’ own website, which I have listed the link.

I understand and I get it, but that is not what the Supreme Court ruled. The case was big - lots of anticipation - front page news plus tons of commentary about it. The republicans were very upset by the ruling. The case was 10 or 15 years ago, I believe.

Anyway, I get it, but unfortunately, the US is required to include illegal aliens in the population counts and apportionment. It is settled law.

I recall before the 2010 Census, Cali was projected to lose one seat, but when everyone was counted, I think Cali picked up one seat, which means there were about 1,500,000 million more residents than the Census estimated and I assume many of those were illegal.
