2A Attorney: 70% of N.J. gun laws could go away if SCOTUS takes up this case on May 23rd

WASHINGTON, D.C. – There’s a major challenge to New Jersey’s gun control regime which could get taken up by the U.S. Supreme Court. A decision will be made on May 23rd.

The Association of New Jersey Rifle & Pistol Club previously initiated Rogers v. Grewal, a challenge to New Jersey’s restriction on carry licenses, and the case has worked its way through the federal judiciary. Next week, the Supreme Court will finally hold a conference at which time the Justices will sit around a giant conference table, discuss the points of law implicated by cases awaiting action, and ultimately vote on any pending petitions of certiorari (a request for SCOTUS to review a lower court’s decision).

The stakes are potentially huge.

That’s because the circuits are split. The First, Second, Third, and Fourth Circuits have issued decision favorable to strong state gun controls concerning carry licenses; the Seventh and Ninth Circuits along with the influential D.C. Circuit went in the other direction. This is an opportunity for the Highest Court in the Land to resolve the dispute… if they take it up and grant cert.

If SCOTUS hears the case, how the High Court rules will likely turn on whether a majority believes “strict scrutiny” is the appropriate standard of judicial review for gun control carry laws.

How the hell is it that a gay marriage certificate now must be honored in all 50 states, but if I carry with my permit in the Northeast, not only do they NOT honor it but can slap me with a felony.

NJ has got to be the worst state in the country-—Yes, worse than CA, NY and MD. I fled that SH 7 years ago and hate when I have to go into the state unarmed. You are correct how “government created rights” trump God given ACTUAL written rights. This needs to stop....

Its closer to 100 percent

Jackson Township, which is considered one of the most Republican (RINOS) areas in the state, is being sued for delaying gun purchase permits up to a year or so. When 30 days is required by law.

Because of a little know thing called Reciprocity Agreements. More or less, administrative functions between the states. Believe it or not, your state has a reciprocity agreement with the other 49 for your drivers license, buried somewhere deep in the state code book.

Hell, at one time, a Georgia CCW was not accepted in South Carolina. I actually called a South Carolina Rep one day. He explained that the two legislatures couldn’t agree on the language of the agreement. SC requires a 4 hour course. Georgia does not. They did finally get it done, though.

I understand that, but my question was rhetorical. Why is it that homosexual marriage, now a constitutional right by judicial fiat, has forced reciprocity with all 50 states by virtue of a 5-4 SCOTUS decision, but an actual, explicitly enumerated and original Bill of Rights ratified constitutional right can wind you up in the slam for exercising it in the wrong state. This is insanity.

This seems doubtful to me. The Gay Marriage stuff was accepted virtually overnight by all the States. Gun stuff gets different treatment from legislation designed to destroy our culture.

I know of no final Ninth Circuit decision reflecting any thing other than outright hostility toward gun ownership. Every favorable decision by three judge panels on the Ninth have been set aside, as far as I know.

I would be happy to hear of any exceptions.
