It’s a violation of 8 USC 1325 which is federal criminal code.
And it says quite clearly in the text...”Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed”

This is just the most recent judicial activist action that tell us th Republicans in the Senate need to get off their dead asses and confirm TRUMP NOMINATED JUDGES to fill the 142 VACANCIES. And the poseur Graham needs to stop honoring the extra-Constitutional Blue Slip process that allows DemocRATS to steer Judges such as the one in this case to become the confirmed nominee.

It would be nice if that were true but unfortunately the US constitution makes no distinction between citizens or legal or illegal aliens.
Illegal aliens enjoy all the protections of the US constitution with only a few limitations such as voting, and firearms possession. But that does not mean they can't be deported.
I believe the judge messed up here, illegal presence in the US is a civil/administrative violation but it is also a federal crime 8 USC 1325 for the act of entering illegally.

This has to be the only country in the world where police are not allowed to arrest people who are in the country illegally.
Wow, in addition to the sentiments expressed earlier in this thread, it looks like the Judge is singling out the officers for personal liability. The message will be that no police officer in this jurisdiction had ever again arrest one of the Left’s protected invaders for an immigration violation.

So this judge thumbs his nose at illegal activity like being in the country illegally. Judge needs to be removed ASAP for NOT adhering to the LAW and ignoring his SWORN OATH to uphold it!
Judge Richard Jones is either corrupt or has an extremely low IQ.
If we are going to selectively enforce federal law, then there are some that I would like to have selectively unenforced myself.
