Need Congress to limit the authority of Article one judges under its constitutional checks and balances on its own creations. But first have to win a majority of both Houses that is: GOP, pro-American and pro-Trump. Would love to impeach some Obama judges, but doubt we can get enough Senators in time to do so. But we could shackle their power after the next elections.

So let’s get this straight, Obama’s executive orders and executive regulations are not “illegal” but simply reversing them is?

It is time any POTUS starts telling judges who think THEY make federal policy that their orders are going to be ignored, and THEY can try to appeal their writ, to Congress. If Congress writes legislation, and the president approves it, then there’s a law to be respected, but that is how legislation is done, not from the judicial bench.

In most of these cases, the judges use the “Administrative Procedure Act” to stop Executive Orders or Executive agency rules and regulations.

Their favorite “legal weapon” is to claim that the President or another government executive has been “arbitrary or capricious.”

I don’t remember where the Constitution gives federal judges the right to overturn executive orders. Am I missing something?

There needs to be a rule that if you get overturned by the Supreme Court 3 three times you lose your job for cause of incompetence. This I feel will solve this issue.

It is possible that she is correct on the law but it certainly seems counterintuitive. It should be easily enough verified if she is correct as to that point.

If the law IS written as she has indicated, it would seem to be unconstitutional. Allowing one President to invoke something with the stroke of a pen that another President cannot rescind without an act of Congress would seem unlikely to pass Constitutional muster. unlikely

You can say that again....

As this case shows, DISTRICT JUDGES ARE IMPORTANT. There’s no excuse for the Republicans to be allowing over 100 District Judge positions (of a total of 667 Authorized District Judge positions) to be sitting VACANT.

The courts are out of control and as corrupt as the corporate media.

Under the Constitution, Congress has lots of tools to rein in the corrupt and arrogant judiciary. We need to elect Congressmen who will use those tools.

Judges are supposed to rule on law, nothing more. What lawsuit is this a response to? Then explain the legal reasoning behind the ruling.

This BS of just “declaring” something to be illegal without citing specifics as an answer to a lawsuit is lawlessness. They’re literally making up law as they wish. Surely this is criminal?

...we can always ignore, they can’t enforce.

Must every single federal judge in the entire nation agree with an executive order for it to be lawful?

How come Obama's original executive order was lawful, yet Trump's overturning of said eo is unlawful? BLACK PRIVILEGE?
