'Fox & Friends' host Kilmeade: Trump 'would set a terrible precedent' with national emergency order

"Fox & Friends" co-host Brian Kilmeade warned President Trump Thursday morning not to declare a national emergency to build a border wall without getting congressional approval, arguing it would set "a terrible precedent."

"It would be a disaster in the big picture and it would show us being inept and unable to govern around the world," Kilmeade said. "It would set a terrible precedent."

“The next president, if it is a liberal president, will say a state of emergency will be climate change," he added. "Look at what happened with [Hurricane] Sandy, look at what happened with the earthquake, look at what’s happening to the polar bears, who’ve no place to walk on ice.”

"This would be a bad sign that the courts are forced to do something that politicians can't," Kilmeade concluded.

The commentary comes as the partial government shutdown reached its 20th day on Thursday with no compromise on the horizon.

Trump has strongly hinted at declaring a national emergency to end the impasse over his long-promised wall, setting up a possible confrontation on Capitol Hill.

Kilmeade recently has been critical of the president on issues including his decision to pull troops out of Syria.

"Nobody thinks ISIS is defeated," Kilmeade said on Dec. 20, before also adding, "For the president to declare victory just is inaccurate."

Trump reportedly watches "Fox & Friends" on a regular basis and has done multiple interviews with the program since taking office. He has also taken to Twitter to laud the show's ratings performance against the competition.

We have about 31 current "national emergencies" underway. Some get "renewed" annually to provide "cover" for actions without getting Congress involved.

FDR became a de facto dictator on the basis of a declared “national emergency” and no one says a word about it. The reaction simply depends on who declares the national emergency.

The incredibly obvious difference is this: Congress has already directed the president to build the wall.

Don’t know but he is not a real sharp tack. I do not seen any credentials, experience or anything noteworthy where I or President Trump would stop and listen to what he says.

When Kilmeade starts calling for withdrawal from Iraq and Afghanistan because Congress never declared war, I’ll start believing his concern about the president supposedly misusing the emergency mechanism to protect our border.

Sorry, Brian. Your assumptions are either mistaken or incorrect.

The fact the Trump would declare an emergency, then build a wall makes it no more or less likely that a future RAT president would do something similar. "It's not been done before," does not impede RATs.

Second, it's not merely an academic exercise in political theory. We're losing our country. What's your plan for after 40 million more illegals cross the border, claim their rightful place in the sun, complete with bennies?

The incredibly obvious difference is this: Congress has already directed the president to build the wall.

Equally obvious is that Congress authorized construction of the wall when they passed the Secure Fence Act of 2006, but has never allocated the resources to fully fund it.

It was another Schumer sleight-of-hand to placate Dubya. "Here's your fence, but no money to build it."
