'Fox & Friends' host Kilmeade: Trump 'would set a terrible precedent' with national emergency order

"Fox & Friends" co-host Brian Kilmeade warned President Trump Thursday morning not to declare a national emergency to build a border wall without getting congressional approval, arguing it would set "a terrible precedent."

"It would be a disaster in the big picture and it would show us being inept and unable to govern around the world," Kilmeade said. "It would set a terrible precedent."

“The next president, if it is a liberal president, will say a state of emergency will be climate change," he added. "Look at what happened with [Hurricane] Sandy, look at what happened with the earthquake, look at what’s happening to the polar bears, who’ve no place to walk on ice.”

"This would be a bad sign that the courts are forced to do something that politicians can't," Kilmeade concluded.

The commentary comes as the partial government shutdown reached its 20th day on Thursday with no compromise on the horizon.

Trump has strongly hinted at declaring a national emergency to end the impasse over his long-promised wall, setting up a possible confrontation on Capitol Hill.

Kilmeade recently has been critical of the president on issues including his decision to pull troops out of Syria.

"Nobody thinks ISIS is defeated," Kilmeade said on Dec. 20, before also adding, "For the president to declare victory just is inaccurate."

Trump reportedly watches "Fox & Friends" on a regular basis and has done multiple interviews with the program since taking office. He has also taken to Twitter to laud the show's ratings performance against the competition.

I see where Brian is coming from on this, but a future liberal President couldn't declare a state of emergency over Global Warming, then implement a carbon tax, for example.

However, I suppose a future Liberal President could declare a national emergency over lack of health care, and spend money providing "Medicare for All."

There’s only a problem when you declare something that is not an emergency an emergency. Global warming is not an emergency.

Kilmeade says he wants Congress to compromise. Get people like Dick Durbin, Susan Collins and other reasonable types to take over the negotiations from Trump, Schumer and Pelosi.

Sometimes Kilmeade is humorous, other times he’s cringeworthy.

I’m sorry, this is a military crisis. This is a physical crisis.

If global warming or any other climate disaster occurs, we can declare and we do emergencies.

I wish these people, esp this guy, would STFU...

I doubt if Trump will listen to him, so why even waste the breath.

There can be no congressional approval, anyone failing to see this now is an idiot.

According to Levin, Reagan declared several emergencies under the law that Trump could invoke. Seems a lot of NeverTrumpers are showing their true openborders colors. They aren’t opposed to unilateral presidential action that sends troops to, say, Syria. But they don’t want border protection at home.

This is the same bull$hit argument that The Turtle uses in the Senate for not changing the rules there to facilitate approval of appointees and other things. There is NOTHING in the Constitution that demands that the Senate operate as it does, and with the direction of things today, you can bet that when and if the RATS get control of either the Senate or the Presidency, you can kiss these “rules” goodbye!
And as a corollary here, Trump needs to do everything in his power to remake our Judiciary, because that’s been the Left’s “trump card” in controlling the other two branches of government to achieve their Socialist/Marxist goals.

Trump would set a great precedent with this. A strong communication needs to be south that says our country is not a destination. Don’t pay the gangs to smuggle you, your children, your drugs or your daughters to America. And a strong precedent needs to be communicated that Businesses can’t hire slave labour.

If you worried about setting precedents for future “what if” scenarios nothing would ever get done. Half of the EOs issued by Trump could be considered precedent setters, for example, what would prevent President AOC in 20 years from issuing a ban on conservative websites similar to Trump’s travel ban?

Not sure. Prior to the campaign Trump would call into their show every Monday, so I think they were all on good terms.
