The gist is this: if an unelected government official decides there is sufficient need, the patent for a new drug can be voided.

Patents do need massive reform in healthcare. Patents are inherently anti-capitalistic and should be given with care and only for a short period of time.

Patents are necessary to foster innovation by allowing the inventor a period of time to exploit their invention before others can use their technology. Without a patent, there would be little incentive to invent because R&D is expensive.
However, patent and especially copyright durations have become excessive due to crony capitalism. Bring the duration of both back in line with reality and we’re good again.
Patents are inherently anti-capitalistic. Republican party has always been pro-corporate America, and not necessarily capitalistic. Capitalism, by definition, has many buyers and many sellers for goods. A patent grants a monopoly, removing the “many sellers.” Patents should be granted, but for a limited time. Patents were never setup so one industry could make 3000% profit margin for 20 years, then slightly alter the formula to get another 10 year extension. This is why healthcare costs have gone up at 2x+ the rate of inflation since the 70s.
Wish all college freshmen be forced to read, and possibly, understand ATLAS SHRUGGED...I’d settle for forcing them to watch 2 or 3 of the movies remakes of it...
They can plan whatever they want. It will not pass the Senate and certainly not a veto.

Foolish. Without patent protection, no company would invest the billion or so dollars it takes to discover a new drug. So thats the end of new cures. Congratulations!

Patents can be abused, but so can copyrights (which can be worse). You need something to protect Intellectual Property right or people won’t be motivated to innovate.
And, for purposes of preemption: Open Source Software is NOT innovation. Almost all OSS projects are knock-offs of proprietary software packages.
Again, re-read what I said. Patents are needed, but the current system needs massive reforms. The current system rewards marginal improvements in drugs rather than cures. And there are things you can do to reduce the cost of a new drug, including not having it normally take 10 years to prove out. 5 year patent should be more than sufficient.
That's one of the most stupid and shortsighted statements I have ever read on this site. Depriving drug companies, or anyone else for that matter, will completely stop any more development of new products.
I never met either of my two grandfathers. They both died at an early age of diseases that today are cured from a drugs that today are so inexpensive that my local drug store gives them away free as a loss leader. At the time, my grandfathers would have given their whole net worth in order to get them. As someone who is currently a cancer patient, the last thing I want now is for drug companies to stop development of new drugs.
Federal LAW requires about $2 BILLION in costs to bring a new drug to market. In comparison, the production cost of drugs is essentially zero. Prices are set to recover the $2 billion development cost, not the production cost. The US government should do nothing to stop the development of new drugs.
By definition, capitalism requires many buyers and sellers. The reason it works is because you have multiples of both and therefore have true price discovery. Granting a monopoly - especially for 15-30 years, is not capitalism. That is crony corporatism. Our medical patents don’t even differentiate between marginal improvements and cures.
You need to re-read what I said. I am not arguing for zero patents. I’m arguing what we have now is crony capitalism. We currently give 15+ year patents. Maybe 2-3 years is fine, maybe 5. Why is 15-30 the right # of years? Why not forever?
If I had the energy I might try to re-write Atlas Shrugged.

With some tweaking, the basic story could become a best-seller today with a young generation of people who sense that the world is broken and who want to do something good to make the world better.
I think many people sense that they’ve been lied to about the world — so they are ripe to hear the core message. But they just don’t realize that their College Professors are the ones who lied to them. They could really have a grand “AHA!” moment if they read an engaging book about freedom and responsibility.
