A federal judge temporarily blocked the Trump administration from denying asylum to migrants who illegally cross into the United States, saying the policy likely violated federal law on asylum eligibility.

The judge pointedly denied the claim that the president, by fiat, could give the manner of entry added legal weight as a determinant of asylum. He reasoned that the

While these activist judges are legislating, they should just go on and lecture us about how they are just limiting the powers of the Presidency as a means of proper checks and balances. The power of the President to protect the country is just so overrated.

Were there any Federal Judges who ruled that it was completely unconstitutional for Obama to have created DACA? Any at all?

I doubt it.

The so called judge cites the UN but neglects to mention that the UN also supports asylum seekers accepting asylum in the first safe country they reach. Mexico offered that. These judges like typical Demoncrats pick and choose what they use to oppress and endanger America.

It seems to me that the only way an immigrant could claim automatic asylum was if their country of origin appeared on a State Department list of qualifying nations. Ie. a repressive communist regime (North Korea, Soviet Union, Cuba, GDR, Albania...) or a nation that was experiencing a violent civil war (Nicaragua, El Salvador...). If your nation wasn’t on that list... sorry.

I remember an apartment building full of Iranian college students at Penn State. The Shah fell and their status was up in the air. They were here on student visas, but when they expired the Iranian students had to go home because the State Department under Jimmy Carter didn’t see fit to put Iran on “The List”.

The order reflects the judge’s view

The judge's view is not relevant in the matter.

It's not his place to insert his private political views into his job.

His responsibility is to determine if law has been followed or broken.

I believe the ROE changed slightly to include rendering protection to Border Enforcement. That ‘could’ involve the armed forces in quelling a riot at a detention center (just as a for-instance).

We do. It’s law. The President doesnt make law. We have (have had for almost 30 yrs) a feckless, globalist Congress. Trump cannot unilaterally change that, or what he change, is hard to do overnight. Just like a person who is 100 lbs overweight, they didn’t get there in a day, nor will we fix this in a day. Roll the dice and take it to SCOTUS...but recognize if SCOTUS rules and “makes law”, that’s exactly what we complained about. The only real fix is for Congress to act and change the law. But let’s not hold our breath.

Actually, as much as I don’t like the decision, it is what the framers had in mind. Change the name from Trump to Obama (or Clinton) and tell me again, how you feel about that. This is only a temporary injunction. Let it go to SCOTUS. But we shouldn’t want SCOTUS to create law, either.

They can shut down the San Ysidro border once or twice a day depending on the mood of the CBP.

It will have the same actual effect as a complete border shut down and will negate these judges’ orders.

The judicial branch has usurped not only presidential authority and powers, it also legislates from the bench. We cannot permit one branch to dominate the other two.

The USSC needs to put these partisan judges in their place. This crap is really undermining our republic.

I guess not .

Trump knew a lib judge would throw this out and 50,000 would roll in .

He must think this same stupid will satisfy posters like you .

He must think it helps him .

It does not .

The only way to stop this invasion is to shut the border .

Make Mexico pay for its actions .
