In a blow to Trump’s immigration agenda, federal judge blocks asylum ban for migrants

A federal judge temporarily blocked the Trump administration from denying asylum to migrants who illegally cross into the United States, saying the policy likely violated federal law on asylum eligibility.

The judge pointedly denied the claim that the president, by fiat, could give the manner of entry added legal weight as a determinant of asylum. He reasoned that the “interpretive guide” of United Nations compacts on asylum lent extra force to congressional requirements. The intent of Congress, Tigar wrote, was “unambiguous.”

And the Obama judge cites the United Nations within his reasoning.

Crossing outside the ports of entry is dangerous, costly and risky to the life of the person. Everyone knows that, but this judge.

Can one get an emergency injunction against an emergency injunction?

Obama appointment doesn’t even get mentioned. If Trump goes to court and gets one of his picks, it’s in the headline or near the top. Then the judge folds in an attempt to burnish his impartiality.

I hate our corrupt media.

saying the policy likely violated federal law on asylum eligibility

Likely? He's making a ruling based on something that is likely?

Can't President Trump just ignore this idiotic ruling that doesn't even have any basis in law?

Like that wasn’t going to happen no matter what the law or constitution says.

Exactly. This already went to the Supreme Court and President Trump won. He has the right to decide who comes in to the country.

Point taken. I searched the article for “appoint” and got nothing. Should have searched for Obama.

Who died and made any and all Federal judges King/Emperor/Tyrant and Congress, having supreme authority over anything they want to stick their noses into?

Did I miss something in high school civics class? Three co-equal branches of the Federal government should be the Legislative (Congress), Administrative (headed by the President) and Judicial (Supreme Court).

Allowing one Federal Judge to overrule Congress or the President is the equivalent of allowing one Congressman to decree a new Federal law.

Insanity! How does Marbury v. Madison encompass this?

They always pick a “judge” in the Ninth Circuit - either San Francisco or Hawaii - why the hell should one lone district court judge citing the damned United Nations of all things - be able to override the President of the US??

Immediately bus any migrants who cross the border now directly to the judge’s house and tell them to knock on his front door.

We are reaching the point where the right and the left are going to agree that we need to burn it all down. The existing system is so corrupted by the leftist Marxists that it cannot be saved. The Left wants a Latin/South American country so give it to them, starting with judges who disappear or spend their last days in small windowless cells.
