Judge denies Native American motion to block new North Dakota voter ID law

A judge denied a North Dakota tribe's emergency motion to block the state from implementing a key part of its strict new voter ID law just a few days ahead of the midterms, citing the confusion such a change could cause ahead of the "fast approaching" elections.

"The federal courts are unanimous in their judgment that it is highly important to preserve the status quo when elections are fast approaching," U.S. District Judge Daniel Hovland wrote in the order denying the emergency motion. Hovland also wrote that the details provided by the Spirit Lake Tribe in the complaint provided "great cause for concern" and would require "a detailed response from the Secretary of State as this case proceeds," but maintained that "a further injunction on the eve of the election will create as much confusion as it will alleviate, and is foreclosed by precedent which is hesitant to permit 'eleventh-hour changes to election laws.'"

The voter ID law, which requires all North Dakotan voters to provide a state- or tribe-issued ID with a residential address in order to vote, has been the subject of legal back-and-forth for years because Native American tribes hold that it disproportionately affects Native Americans who live in rural communities on reservations and often don't use residential addresses, but rely instead on post office box addresses to get their mail. According to studies commissioned by Native American rights groups, roughly 35 percent of that population doesn't have an acceptable ID with a residential address.

Time the reservation joined the twentieth century. Everyone outside a res has a street address due to 911 emergency response.

I am Choctaw and have followed Indian voting patterns for many years. In South Dakota in 2002, the Pine Ridge reservation votes were the last votes “counted,” and the nearly 100% Democrat tally allowed Tim Johnson to defeat Thune by a few hundred votes out of about several hundred thousand cast. In 2004, the same ploy did not work and Thune defeated, Tom Daschle, one of the sorriest swamp creatures of his day, by 7,000 votes.

The constitution leaves voter rights/regulations/ rules up to the individual states. The judge should have bounced this out of federal court without comment...

Pretty sure they have a street address INSIDE the Res also. What do the propane truck driver’s use for deliveries & billing???

Back when I was a pup in North Dakota, they were the only state without registration at all. Precinct judges were supposed to know all voters in their jurisdictions and most of them did. That worked when the state was mostly rural and there was little turnover.

The Supreme Court refused October 10 to intervene. A lower court injunction right now would be quashed in 15 minutes.

Daniel Lee Hovland (born 1954) is the Chief United States District Judge of the United States District Court for the District of North Dakota.

Hovland was nominated by President George W. Bush on June 26, 2002, to a seat vacated by Patrick Anthony Conmy. He was confirmed by the United States Senate on November 14, 2002, and received his commission on November 26, 2002. He previously served as chief judge from 2002-2009 and reassumed that role on November 1, 2016
