“Either there was a paperwork error or a misunderstanding as to what going before the judge was about.”
Based on personal experience, it’s likely the appearance before the judge was a private adoption.
That’s what we did in Hilo, Hawaii with our daughter (born in South Korea) in ‘86 - still have the picture with the judge.
We then flew back to Honolulu and, 10 days later, went through a public naturalization ceremony - at the end of which our daughter received a Naturalization Certificate, which she still guards carefully today.
This is the step the parents (apparently US Citizens) missed, and yes, it is their fault. This lady is a victim of her parents’ stupidity, carelessness or ignorance. She should be allowed to go through the Naturalization process without the wait.
Sounds like a plan to me.
Too bad we’re talking US bureaucrats here. They probably won’t go an inch out of their way to help her.
I agree. People from foreign countries adopted as little children by American parents should have always been treated as “naturalized” (via their adoption). The law that only changed that going forwars was a mistake, it should have been retroactive.
I feel especially for the man, born in Korea, with a very troubled adopted family past, being shunted from one bad adoptive family to another just as bad, winding up on the streets and falling into crime - that is now jeapordizing his situation here, due to how the nation is trying to deal with all the “illegals”, WHICH HE NEVER WAS.
Those adopted before the law was changed deserve better than they are getting.
At an absolute bare minimum, temporarily, they deserve a “green card” as a full LEGAL resident, because their adoption made them legally here.
Then, with them as legal residents, we have time for Congress to correct its error in not including them in the change that made other foreign adopted kids citizens.
IF she worked in all those places, even with security clearances, she must have had a Social Security number & card in her possession.
Her Soc Sec benefits would be tied to her own earnings.
Something doesn’t match up in this story.
I dont think that SS wage garnishment requires citizenship”””
Being on a payroll certainly does. She would have to have filled out a form I-9. There are many pieces of information she could have used, but employers would have been required to use the form I-9.
I have been a payroll supervisor. I couldn’t even hire one of my brothers without them filling out a form I-9.
“should be allowed to go through the Naturalization process without the wait.”
So, you are saying that she is a a Dreamer?
No. A “dreamer” is someone who came or was brought here illegally or was born here to an illegal mother.
The lady in question was brought here by an American Citizen legally and, it appears, adopted legally. Having gone through the process, it’s likely she was issued a new birth certificate in her new name (given to her by her adoptive parents) after a private adoption in front of a judge (an assumption), which allowed her to obtain a social security card.
The fact that her parents didn’t know (an assumption) that the adoption didn’t make her a US Citizen should not be held against her. She should be allowed to go through the Naturalization process.
Dreamers’ whole existence in the US is illegal. If they want to go back to their home country and go through the legal immigration and naturalization process, I don’t think anyone would have a problem with that. If the US wants to waive waiting times for this, I don’t think anyone would have a problem with that, either.
“The fact that her parents didnt know (an assumption) that the adoption didnt make her a US Citizen should not be held against her. She should be allowed to go through the Naturalization process.”
I’m not sure we want to set a standard that says “If your parents lied about the circumstances of your citizenship, even thought you are not a citizen, you will automatically be granted Amnesty.”
One of my friends is this way. She was adopted from China as a baby.
“Im not sure we want to set a standard that says If your parents lied about the circumstances of your citizenship, even thought you are not a citizen, you will automatically be granted Amnesty.”
Not everyone has to agree with me that decisions could be made based on the legality or illegality of your immigration situation.
Don't be an ass. She was adopted by American citizens, not smuggled in by illegal aliens. Denying her citizenship is devaluing her parent's American citizenship.
Unless she was adopted illegally, she should be treated the same as any other American born overseas to American parents.
From the article:
“In November 2015, US Senator Amy Klobuchar of Minnesota introduced legislation to grant citizenship to adoptees from earlier.”
This is nothing but an attempt unduly citizenship to people that are in the country illegally.
As for Kim Yang Ai, we know that she voted illegally and likely illegally obtained a Social Security Card.
Her argument has as much validity as a DACA Dreamer.
As with the Dreamers Kim Yang Ai must face the consequences of her parents’ actions.
“Something doesnt match up in this story.”
Exactly!
She voted and she had a Social Security Card, and conveniently, no U.S. Passport.
That’s Fraud!
Based on what?
You don't get to pontificate unless you're the Pope.
American parents adopted from Korea. Conflating that with illegal aliens smuggling their kids with them is just plain benighted.
You're not attacking illegal aliens; you're attacking the privileges of being an American citizen.
“American parents adopted from Korea.”
Where is the evidence that she was legally adopted?
Cheese and Rice. Build the effing wall, already. Stop this nonsense!!!
You need to quit using words you don't understand. "Fraud" is deception "by definition!"
How do you "deceive" from ignorance of ones true status?
Frankly, as another poster said, I'm more inclined to believe the Social Security Administration screwed up than this ladies parents made up their story from whole cloth.
“How do you “deceive” from ignorance of ones true status?”
Do you support a policy that would grant Amnesty to anyone who incorrectly thought they were U.S. citizens?
If not, why is Kim Yang Ai’s case different?
“You’re not attacking illegal aliens; you’re attacking the privileges of being an American citizen.”
Kim Yang Ai is not an American citizen.
The fact she held a security clearance and that NO OTHER investigating agency besides the SSA turned up ANYTHING throughout her ENTIRE LIFE!
So hold on a second here... First, YOU need to demonstrate you have enough background in the subject to EVEN HAVE an opinion! The woman held security clearance to work on a nuke site, something I doubt YOU have. If you can ignore THAT evidence, what evidence CAN'T you ignore?
So far, you've done nothing but pull gratuitous assertions out of your poop chute, which according to the laws of logic, may be just as gratuitously IGNORED!
