Judge blasts man for selling military-style rifles in Chicago: (barf alert)

Saying he “can’t think of a worse crime for someone to commit” in a city besieged by violence, a federal judge on Wednesday sentenced an Arkansas man to more than seven years in federal prison for selling military-style semi-automatic rifles and other guns to a felon in Chicago.

In handing down the 87-month sentence, U.S. District Judge Ronald Guzman told Klint Kelley that his actions undoubtedly contributed to the city’s “intolerable level of gun violence,” even though the guns he trafficked weren’t directly connected to a shooting.

As more than a dozen of Kelley’s relatives and supporters — most of them from Arkansas — looked on from the courtroom gallery, Guzman described in detail how drug dealers and gang members shoot it out in the streets while Chicago neighborhoods “disintegrate” and parents “walk their children to school through safe zones.”

“Caught in between are innocent bystanders,” Guzman said. “Kids shot while skipping rope in front of their homes, people being shot while sitting in their living room, police officers being shot at and having to shoot back, police officers shooting people who don’t have guns because they are so afraid that they might have a gun. … It is chaos.”

Kelley, 28, of Malvern, Ark., pleaded guilty in March to two gun trafficking charges alleging he sold a total of 21 guns over a five-month period last year to a felon who turned out to be working undercover for the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives, court record show.

Although the “seller” did something really stupid, the whole thing sounds a lot like “entrapment”.

Was the sale performed in person ?

Because this guy in Arkansas wouldn’t have to run a background, would he ?

Was an FFL involved ? Then the FFL would be the blame, no ?

A couple of things to note here.
1.Kelly knew he was selling guns that would end up in the hands of gang members. He's truly guilty.
2.Notice who the felon that bought the guns works for...The ATF.

No, no they didn't contribute as they went to the ATF. That is unless the ATF is selling them on to the gangs.....Don't be too quick to think they wouldn't, it is the ATF after all. The same agency that ran guns to the cartels in Mexico. Maybe the judge knows something we don't.

You must have an Illinois FOID card to purchase from an FFL in Illinois, and no FFL is going to sell a modern sporting rifle to a FOID holder with a Chicago or Cook County address.

I'm sorry, but I'm the judge's side on this one. We don't need new laws banning certain classes of firearms, we need to fully enforce our existing laws, and this idiot from Arkansas trafficking guns to prohibited persons in Chicago, no matter what type of guns they may be, is just the type of person that needs to feel the full force of the existing laws.

Has this judge ever imposed a sentence longer than 7 years 3 months?

Just askin’ because if this is the worst crime he can imagine, no other crime that went through his court could possibly merit a longer sentence.

That’s about the only way the feds can nail somebody (Randy Weaver and the Ruby Ridge massacre come to mind). God forfend that they actually get out in the street and arrest criminals. Better to arrest inanimate objects that don’t fight back.

Details please. Did seller violate Arkansas or federal law? How? How would he know he was selling to an ATF plant/supposed felon? Maybe he was just a gun show sell/buy/trade guy?

Details: You cannot travel across state lines and sell a gun at a gun show. You can only do that within your own state, if your state laws allow it. He wasn't a "gun show guy."

It is against Federal law for any person to sell a firearm to another person from a different state. It is against Federal law to travel to another state and sell a firearm to another person. It is against Federal law to knowingly sell a firearm to a prohibited person. It is against Federal law to transport firearms across state lines for the purpose of making an unlawful sale.

He also violated Illinois state law by selling a firearm to another person who does not have an FOID card, and violated city ordinance by possessing a prohibited "assault style weapon" within city limits. (He lost his Firearms Owners Protection Act exemption when he stopped in Illinois instead of travelling through Illinois to a final destination elsewhere.)

Throw the book at this guy. He and others like him are just giving ammunition to the gun banners, no pun intended.
