You know, I had the very same thought. However, Justice Goresuch has turned out pretty good so far, hasn’t he? Think President Trump is being advised by non-Uniparty people, so have hopes he will make a good pick.

Yup. I personally talked to several people who were not fans of President Trump. They couldn’t stand Hillary but weren’t sure about Trump. They were thinking of just sitting the election out. I simply asked, “who do you want picking at least one and maybe three Supreme Court Justices?” All of them except one eventually told me they were going to vote for President Trump. They GOT IT.

I simply am NTOWY (Not Tired of Winning Yet)! That said, if President Trump was not winning, the impact of his SCOTUS appointments would Trump (pun intended) not winning! It will last for decades.

But we are getting both!

PS We have had some losses. But they pale compared to the winning IMHO.

This is probably a silly question but can members of the Senate boycott the vote? To keep it from happening. The reason my mind is going there is because of the attempts in the past in the house to avoid having a vote take place. I can’t even remember the issue

In all fairness, if Hillary had won and had appointed Garland (or even worse, a leftwing radical) to Scalia’s seat, wouldn’t we all be saying the same thing - this is the end of America as we know it?

Not silly at all.

The rules of the Senate are that a quorum is 51. There are 51 Rs and 49 Ds right now, but McCain is absent. So, it is theoretically possible for the Ds to prevent a quorum by boycotting.

However, there are two special rules. 1. No one knows if Mike Pence counts or not, since he is allowed to cast a tie-breaking vote. If he counts, then at least one R must be absent for there to be no quorum.

2. and even more interesting, a quorum is presumed to be present unless someone requests a roll call. Now if all 50 Rs are present, but none of them is willing to be obstructionist by asking for a roll call, we have the situation that a D must make the request. But if a D is present to make the request, then they have 51 present and there is a quorum.

The more likely scenario is that McCain will pass before the vote, and then it comes to a matter of whether he will be replaced before the vote. I suspect he will be, but the governor of Arizona is going to be under a lot of pressure in some cases.
