Deepest blow yet to Trumps phaseout
....Judge John D. Batess ruling would require a full restart, meaning even illegal immigrant Dreamers whod never been approved before would now be able to apply for DACA.... judge imposed a 90-day delay on his own ruling to give the government a chance to reargue its case, but for now the ruling stands as the most severe blow yet to Mr. Trumps phaseout.
Judge Bates said the governments reasoning for revoking DACA wasnt convincing enough, and so it amounted to an arbitrary and capricious decision, which makes it illegal under the Administrative Procedures Act.
The Departments decision to rescind DACA was predicated primarily on its legal judgment that the program was unlawful.

Do you remember, back in the old days, when we were not ruled by a council of judges?
All three???
Why does the judge think that the Administrative Procedures Act overrules an EO by the President?
Where is the constitutional basis for this decision? THERE IS NONE! Unconstitutional federal court decisions must be IGNORED AND REJECTED and President Trump must continue his efforts to stop invasion (the immigration of illegals and enemies) as mandated by the Constitution (U.S. Const., Art. IV, Sec. 4).
Im reminded of the oft used but seldom accredited quote:
Some people just need killin
DACA Was illegal in the first place, and no judge can tell a President to violate the law. Trump should have the idiot arrested.
I think it is time we rid ourselves of “judges.”
I’ll let you guess by what method I have in mind.
So...we are now at the point where a new President cannot rescind the EXECUTIVE ORDER of a prior President? Hilarious. True banana republic status.
Lol.
+1
Not as a judge.
Unlike the "arbitrary and capricious" EO from Zero that brought "DACA" into existence?
Impeach these judges
So a JUDGE now can prevent a president from repealing a past president’s unconstitutional EO?
Am I wrong in summarizing that DACA was an executive order that the courts allowed, but the same courts are now not allowing an executive order to repeal DACA?
Are executive orders only “legal and binding” when the judges agree with the POTUS who issued them?
So an Executive Order which started DACA is rescinded by an Executive Order which is then blocked by a Judicial appointee.
So much for Separation of Powers.
Let’s relax. 90 days for govt to respond and then up to Supreme Court and hopefully someone dies on the left of natural causes on the SCOTUS
We won the election. Trump is doing a lot of good.
There’s no tipping point right now.
85 percent of the people accept Trump as their president, which is in line with every other president’s numbers.
I DO AGREE we are at a tipping point with figuring out how to take such power away from judges.
BTW, ALWAYS enjoy your threads and comments
When will Trump start saying “that’s unconstitutional?”
I was afraid of what the link might be... but it was okay :-)
This is a serious question - How do you figure you don’t need any Democrat votes to declare DACA illegal. Last time I checked, it takes 60 votes to get a law through the Senate (I know it is a rule, but the Constitution says that the Senate can make up its own procedural rules).
