Mueller invokes unusual ‘conspiracy to defraud government’ charge to ensnare more targets

Special counsel Robert Mueller and his prosecutors have invoked an unusual “conspiracy to defraud the government” charge to ensnare a Russian cyber network and could use the same legal strategy to go after President Trump and his associates, even if the conspiracy is not linked to a criminal act.

Although the president constantly denies any wrongdoing, Mr. Mueller’s 10-month long investigation has become the heart of the Trump-Russian election meddling saga, dominating headlines and leaving the White House tangled in conflict and controversy as additional charges have also been filed against four of his close associates — with further indictments likely.

Last month, Mr. Mueller, a Republican and former FBI director indicted 13 Russian nationals connected to the Internet Research Agency (IRA) Russian “troll farm,” accusing the IRA of interfering in the 2016 U.S. presidential election by spreading fake news stories through U.S. social media. The same approach was employed in securing a plea deal last month with Rick Gates, the aide for former Trump campaign manager Paul Manafort.

What has attracted attention in legal circles is the underlying legal theory behind the indictments, accusing the Russians of essentially committing a crime by preventing agencies of the U.S. government from carrying out the duties. Mr. Mueller appears to be leveraging the theory “into a powerful instrument with respect to both foreign and domestic actors,” according to a recent article on Lawfare, a national security blog by the Lawfare Institute and Brookings Institution.

Shows up frequently in welfare fraud, securities violations, and all kinds of other stuff.

That is not surprising since that seems to be what the statute is intended for. Have you ever seen that charge applied to someone trying to influence the outcome of an election? Mueller seems to be arguing that efforts to influence voters, since they might effect the outcome of the election, are a fraud on the government. That seems like quite a stretch.

So they took the spot along the Merced River instead of the one they rented.

Mueller's argument is more like "They took their assigned spot, but it turned out they told other campers that the spots along the river were better, which may have caused some of those other people to select spots along the river for next year instead of spots near the outhouse where Hillary was camping."

And somehow that interfered with the functions of the government.

Martha and Bob were doing 60 mph in a 55 mph zone. They were in a hurry so they didn’t slow down, nor did they report themselves nor volunteer to pay a fine. They conspired to defraud the US Government!

Please Lord protect our President and all of us from evil, and if it is Your will please get rid of Mueller and his investigation. It has been stressing me a long time. When bad people try to hurt Trump they hurt lots of other people too.

I think he’s trying entrap Trump and his associates by wrapping them around an axle. He’s a horribly brilliant manipulator. Even if he creates a knowingly false narrative he also knows he’ll have the press relentlessly attacking Trump convincing everyone that the lie is true. The guy personifies evil.

Trump can and should fire him. He should persuade Congress to pass a resolution exonerating himself and his staff and authorizing the termination to give him political cover. And let’s declassify everything. Pull the agents from the field who would be compromised. I lost confidence in the CIA when they said Saddam was dead, so I feel they are worthless no-loads anyway.
Finally only Congress has authority to investigate a President. If they exonerate him then Mueller’s investigation becomes unconstitutional IMO.

House committee has concluded there was no collusion. The Constitution grants the power of the purse to the House where all spending bills must originate. Based on its own conclusions, and Constitutional responsibility, the House should immediately defund the Mueller investigation.

‘Conspiracy to defraud the US government’ is colorful lawyerspeak for some kind of tax violation or illicitly obtaining government money. ‘Defraud’ legally involves financial gain or loss.
