Dershowitz: Mueller’s Charge Against Flynn is Evidence Of Weakness

This video of Alan Dershowitz on Fox & Friends yesterday is worth three minutes of your time, if you haven’t already seen it. Dershowitz agrees with our assessment that Mueller’s plea agreement with Michael Flynn indicates that he doesn’t have a case. He adds a further point that we haven’t made: the last thing any prosecutor wants to do is force his key witness to plead guilty to lying. That destroys his credibility. So Mueller wouldn’t have gone with the “false statement” approach if he had anything better:

I’m hoping that the Trump Administration takes a “my turn” approach and begins an investigation into the Democrats.

Dersowitz is redefining the meaning of neo con. This life long ideological Democrat was badlly skaken by the policies of the Obama administration regarding Isrrael He is livid that Obama made overt anti Zionism a respectable position to hold and still be a Democrat in good standing. Currently he sees Trump’s overt pro Israel policies to be immensely preferable to those likely to be implemented by a Democratic Administration. He has been defending Trump in a way that would be unthinkable for him ten years ago.

The destroyed credibility argument is a true statement but the bottom line is that if he had an underlying crime against Flynn he would not have settled for lying to investigators. Particularly if the underlying crime related to talking to the Russians.

The Dem talking heads say that the reason he gave Flynn such a good deal is that Flynn is going to deliver Trump. The other possibility though is that he did not have a good case against Flynn.

For obstruction of justice, there has to be an underlying crime. Flynn plead guilty to a crime. muller is building a case for obstruction of justice by firing comey. It’s weak, but no one in congress is going to stop it. I’m starting to believe they will impeach and remove Trump as POTUS. I hope that Trump has something up his sleeve. If not, the only thing we can do is vote and convince others to as well.

Similarly, actor Ron Silver had been an activist ‘Rat for most of his life. A few years before his death, he came out strongly in favor of Bush and many conservative policies. It was mainly because of Bush’s handling of 9/11, and support of Israel, and how the left treats Israel. IIRC, he paid a price in Hollywood for his change of heart.

It’s nice that some people have the capacity to think, make logical conclusions, and have the courage to speak out.

I've speculated that Mueller may have had a strong case against Flynn for something, but it was based on evidence -- from surveillance through a FISA warrant -- that would never be allowed in court.

If Flynn cut a deal why did he have to plead guilty? I would think if you were somehow turning on the president you’d get a free pass—maybe he has bad lawyers.
