After ‘cheese pizza’ post, New Jersey officer arrested for child porn

A corrections officer with the N.J. Department of Corrections was arrested and charged with receiving images of child sexual abuse.

Stephen Salamak, 37, of Lodi, New Jersey, was arrested at his home by special agents of U.S. Immigration and Customs Enforcement (ICE) Homeland Security Investigations (HSI) and charged by complaint with one count of receiving child pornography.

According to documents filed in this case and statements made in court:

Salamak used email to seek and obtain images of child sexual abuse, including images of prepubescent children.

The AP reported: Prosecutors say an undercover officer first made contact with Salamak after he posted on Craigslist that he was looking for women and moms “that are into Cheese Pizza,” a reference to child pornography.

After police executed a search warrant on his email, prosecutors say they found an email with five attachments showing nude images of young girls. 

The charge of receiving child pornography carries a mandatory minimum sentence of five years in prison, a maximum potential penalty of 20 years in prison, and a $250,000 fine.

He was released on $125,000 unsecured bond, with home confinement and electronic location monitoring.

This looks like careful and competent police work. It was certainly a suspicious ad that led to their investigation of his emails, which then led to his arrest.

Can’t find any fault based on what’s in the article.

I am nervous about the wording of the charge-Receiving child porn. If receiving is a crime, especially with email then anyone can be sent an email then busted for it. Soliciting porn would be a different thing and understandable actionable.

Now, if law enforcement in jurisdictions of Podestas, Clintons, et al., would take a clue from these police. With all the evidence out there, why is nothing being done?

If you don't open an email, I don't think you would liable, but that is old legal advice. I had it happen to me once, and was advised not to open the email, because it was obvious about the content. Good point!

It says "Receiving." If it comes into your computer, if you are looking at the subject line on your screen, you have Received it. If the practical meaning is that you also open it, that's good, but if the law is just "receiving" then it will be used for just receiving some time in the future.
