A Florida hotel manager is questioning why a former police officer has not been arrested for punching and knocking out a valet parking attendant during a dispute over an $18 charge.
Ocean Sky Hotel & Resort front office manager Nigel Blair said Monday that it makes no sense that Fort Lauderdale police did not arrest John Kiernan, 37, of New Smyrna Beach, Florida, at the scene.

From the article:
According to police records, he [the ex-cop] told Officer John Czech that Rodriguez said to him, Youre just looking to fight. Czech wrote that Kiernan said his life experience taught him this was an aggressive statement and he chose to hit the guy first though he saw no weapons.
Guess he can sue him. Where’s Bernie Goetz?
Cops are like anybody else. They don’t like to work.
Former police officer, so he’s immune to the law, just like everyone else who has ever worked for the government.
The law only applies to you losers, not to our lords and masters.
> Guess he can sue him. <
True that. But as it stands now, the ex-cop’s attorney can say: “Ladies and gentlemen of the jury, this was self-defense. Remember, my client was not even arrested.”
It’s a big club, and the average citizen ain’t in it.
Likely BS.
Not with a video
> ...the lead officer did not know at the time Kiernan was a former police officer. <
Yeah, I caught that too. And the lead officer probably really didn’t know Kiernan was a former police officer...for about a second.
Absolutely bull excrement.
As soon as he checked his DL he knew.......................
I’m surprised the ex-cop, or his mouthpiece, haven’t claimed the “fighting words” defense. Of course that is just what they’re claiming without using those words.
I complained about police brutality, and a police lawyer told me: "I think your statements are threatening, and I would fear for my life if I met you."
All I did was complain - without threatening, but the guy was telling me: "If I run into you, I can shoot you on sight, claim I was in fear, and I'll get away with it."
These people are animals.
Kiernan said his life experience taught him this was an aggressive statement and he chose to hit the guy first
From part of an old story I partially remember:
Mother to young sons: “Who started this fight?”
Son: “He did, I hit him back first.”
The only defense I can think of for the FORT LAUDERDALE cops who chose NOT to arrest the Atlanta cop was that the video wasn’t seen by them.
But there were apparently MULTIPLE witnesses.
Atlanta cop should be arrested.
Who was threatening to whom?
I really hate it when the burly guys claim the pussy defense.

> But there were apparently MULTIPLE witnesses <
Yes. If you take a look at the brief video at the link, you’ll see a woman run up to where the attendant fell. And bizarrely, it looks like the ex-cop was trying to put the attendant’s hands behind is back when the woman arrived.
How weird is that?
Valet's attorney: So your life experience has taught you that those words by somebody is an aggressive statement?
Kiernan: Yes.
Valet's attorney: In 37 years of experience, how many times have you heard this statement?
Kiernan: Dozens
And have all these encounters been with valets while they are at work, or have they been at other places?
Kiernan: Other places
Valet's attorney: What kind of other places?
Kiernan: Bars and clubs and parties.
Valet's attorney: So... you have heard these words before, "you just want to fight", and a fight usually breaks out ...from your own experience?
Kiernan: Yes.
Valet's attorney: What leads up to these words being said? They don't sound like normal everyday conversation.
Kiernan: Usually an argument or disagreement.
Valet's attorney: Do you get into a lot of arguments and disagreements with people?
Kiernan: No.
Valet's attorney: But you do have a lot of life experience with these situations in just 37 years of life....
WHY is he an EX police officer???
> WHY is he an EX police officer??? <
Great question, and one that the parking attendant’s attorney will be looking into.
Don’t know but he owns a gun store in New Smyrna Beach, drives a nice truck and probably has a nice house, hopefully the valet will own them soon and the attacker will be in prison.
I worked security at a couple of Promise Keeper events. At the time, about 1/2 to 3/4 of event security were off duty cops from somewhere out of the immediate area. A lot of small town Barney Fifes.
Watching these 5'-8", 140# guys, push out their chests and strut was funny.
They would congregate amongst themselves and hardly ever speak to one of us non LEO's.
One cop, knowing I wasn't LEO, "copped" an attitude as to why I was there.
My response was" just here to serve others".
He was trying to create a worse case scenario out of everything.
Seriously...a bunch of Christian men, trying to learn to be better Christian men and worshipping God, and he's looking for a drunken brawl around every corner.
Just these attendants seeing men with security shirts on, gives them a sense of security, defusing much of anxiety that could cause an escalation.
Secondly, most of my job was as an information source.
Other than that, corralling or blocking accesses or controlling activities. No big deal. Being larger than average, automatically gives a slight psychological advantage of compliance, ESPECIALLY in a group of men who intend of being compliant.
ONE cop I did find very genial, was the man heading up the security at one event. He was either the police chief or head of SWAT, from Elgin, Il.
